IR1 visa approved!
I just completed the consular interview with my wife and we were approved! In April 2022, she was refused entry to the US under the visa waiver program for intending to work without authorization. She admitted during secondary inspection to entering around 20 times between 2018 and 2022 to help her USC friend with work. A lot of negative Nancies on visa journey, Reddit, etc claimed she would need a waiver. This is a data point to say that a waiver was not needed.

That’s incredible! My husband worked only for a few months here & they are requiring him the 601 & 212 waivers. So I guess it really depends on the officer. Congratulations!!!

@Lucy Gracida since he needed a 212, it seems like he overstayed as well as worked. my understanding is that an overstay is usually an automatic misrepresentation charge and is more severe than simply working without authorization

He didn’t overstay, he was here on a tourist visa for 4 months, we left the US and attempted to re-enter and that’s when they detained him and went through his phone. They found messages from a family friend that showed he had did a few side jobs while here and so they revoked his tourist visa, denied him entry and he was then placed in expedited removal. Every case is different & it’s really up to the officer’s discretion from my understanding. Congrats to your good news though!
