interview/Owe IRS
Hello everyone,
Question for a friend
He enter in US as tourist visa and work with itin number for some years but never pay taxes. Couple of years later, he got his GC and start to pay his taxes only with SSN.
He have a naturalization interview this month and my question is:
Can uscis deny his case because he owe some money from itin number??
I told him to call the irs and pay the amount owed. But he keep saying doesn't need as long as he was out of status when he got his itin number..
What you guys think??

fist of all , an ITIN is supposed to use for work , that’s the first violation bro. the second one The ITIN number is attributed to his name. if he smart enough he better pay the IRS

@kiki thanks. I told he might be denied. But doesn't believe. I guess, if you have a debt with itin or ssn, you owe money to IRS. But he thinks itin and SSN is different. Again, I was not wrong in my point.

he need to pay the taxes owe on his itin. that so bad to hear.
working with itin is not an offense my interview officer on my gc interview said it not an offense at long as I pay back to the irs.

@tee many people works under itin number. Agree if you. As long as you pay taxes. You are good to go. But let's see if he make an agreement or pay in full.

Your friend should call IRS and pay the taxes. They could deny the naturalization application.

An ITIN does not authorize an individual to work in the U.S. ITIN given to spouses and children mainly for employment visa types who has eligible to get the SSN and pay the tax as well get the tax benefits.
if he worked for the xy company and generated payslips as well W2, not paid taxes, both are violating the Law. If payslips not generated or w2 and not filled the tax, he is ok.

ITIN can only used for getting driving license, bank account open etc…

Actually, he got a 1099. I think is the same as w2. He should call the figure out this big mess.

If you received a 1099 form instead of a W-2 , then the payer of your income did not consider you an employee and did not withhold federal income tax or Social Security and Medicare tax and you classified as a independent contractor or self employed. you need pay taxes 100% if something goes audit, u will be royally screwed. I don’t know how did he manage to get the GC.

@jag man, I don't really know how he got his GC either lol. I did everything under the law and I got hard time to get my 10 yrs GC. Paid tax, never have criminal records, tickets. But my friend has so many things going on and was approved on the spot. Can you believe that? Now, he's 1 step forward to citizenship.

overall, your friend will be in good position right now. if any audits from IRS, he might get into more trouble which might causes for anything and he need to face it otherwise he is the real king

Let's see. His naturalization is in January 26th. Hope the officer dont care about the itin.

I do not think the officer will know anything about that. They only do back ground check for criminal. they do not have any record about tax. that’s why you take your tax transcripts with you in case they ask about them. if he applied based on Five years then all he need have the transcripts for that. Regarding the IRS then later on if he got audited then troubles might happen and then he pays the amount and that’s it.

@moe I guess so, the officer asked me if I owe taxes. Said no, and show the tax transcripts. However, If I say no and have pending debt with irs it's a lie. When you apply for Naturalization the most important is your criminal and taxes history. I advise him a lot but I think he wants to play the game with them.

Worst case scenario he will be denied under good morals grounds. He can reapply after 5 years once he clears the mess.

He probably should have sorted his tax issue out before applying for naturalization.
