I think you really need a good consultation with a good lawyer because asylum is scary with this administration

you already have your vawa. did you try to withdraw your asylum case? I have my I-130 interview too while my vawa was pending. I just went to meet with a supervisor At USCIS for my interview because my vawa is pending then he told me that I’m fine and wait for vawa approval. my I-130 interview was denied and now I’m waiting for my vawa.

put withdrawal request for asylum based on pending Vawa and you will be good

@Riri Riri is it possible to put it for pause till my Vawa get approved has I am already entering to 41st month and can’t afford to fight both case parallel withdrawal at this point won’t be risky ? just exploring my safer option before i jump in take decision

don’t withdraw your asylum application speak with your lawyer

I’ll say go to your asylum interview with your lawyer. They currently holding decisions anyway so you won’t get a decision till it’s unpaused. In case you get asylum approval before your VAWA is approved.

@God is everywhere Your lawyer who filed your Vawa should be able to advice you on your asylum in fact the lawyer was suppose to have looked into it before filing your Vawa then advice you then before filing. I would advice you to ask your Vawa lawyer on way forward even if it means you pay him for the asylum consultation on how to proceed which should be his or her normal consultation charge.

Is better to close your asylum application, and follow your vawa case, after your vawa approved then you gonna terminate your asylum.

@God is everywhere withdrawal is not risky. If you know that you have a strong asylum case and you know that it will be approved you can move forward with your interview. however if you know that you don’t have a strong case, it’s better to withdraw it without a decision.

@God is everywhere I would also advise to go with a lawyer even though you don’t have to. It is recommended. your lawyer will stand on business and if you decided to close your case lawyer will make sure it’s done properly. Before you leave, they will give you a receipt notice for case withdraw.

I am going through this situation to my vawa is pending and my asylum case was admin closed but sudden my attorney told me that I have court hearing on Dec 4 2025 and my interview was online and I was waiting online on Webex but my judge didn’t showed up, I told my attorney to file a motion to dismiss or keep the case admin closed, my attorney said right now situation is very bad because of this administration and she said we will file 42B in court, that’s the solution she told me
