Why are you on removal proceedings?

I’ve got married in the past and it didn’t work out so I got divorced like it’s after my divorce with the first one they sent me the removal letter

basically the letter was saying that I have to meet the judge so I can explain to him why they should let me stay here

Did you file an I-751 waiver after the first marriage dissolved? or was it denied? I’d speak to a lawyer asap

the court day for that is on October 31st 2021 and I have interview on May 3rd

so I don’t really know what to do

@Valera Yameogo, did you apply for a new I-130 with your new spouse? And was a lawyer involved in this new application?

No I did it by myself it’s only when I got the letter I had to seek for lawyer because they said I couldn’t do the paperwork by myself

yes but I had to withdraw the case I didn’t get along with my ex wife and she didn’t want to go to the interview. I’ve hired a lawyer that helped me withdraw the Case and help me with the divorce

If they wanted to deport you, they would have done it since. They won’t arrest you during your interview, but there’s a high chance for them to deny your green card. That should be your concern, not the arrest.

why should them deny my Greencard??

because you’re on removal proceeding. You need to waive it in order to qualify for the green card.

I think I have waived it because it wasn’t I don’t think they would give me the working authorization and the rest of benefits

@Valera Yameogo, to see your immigration records, the form to file is FOIA. Your lawyer can also do that for you.

As others have said, it’s vital you see an attorney ASAP. This is your future at stake. in sure a good attorney can help you solve this problem

am in the same boat since you are in removal proceedings you should send first your i130 And if got approved you should request motion of termination to DHS attorney and if they granted it then you send it to the immigration court and if they granted it then you are fine you can go through the normal processings with USCIS for i485 and if they denied it you should go through the processings with the immigration court for i485

@Alidz idk if you are asking me or the person who posted this but for me yes i had 2yrs gc before but we broke up too early so my i751 got denied and my case turned to immigration court so since am already got my second marriage i asked the judge to apply for adjustment of status so he gave us another master court hearing to wait for i130 decision my i130 got approved and we submitted i485 to uscis and we sent motion of termination to immigration court but they denied it and the reason is ( we didn’t reach out the dhs attorney) so we asked the dhs attorney for motion of termination and it’s almost 5 months we didn’t hear from them yet so maybe we are going to have to wait till the next court hearing and ask for motion of termination if they deny it we are going to have submit i485 again with the immigration court and if they granted it we are going to waiting for the interview with USCIS

how long u we’re together after the 2 year green card ?

we got married November 2018 so it’s almost 3yrs also we got married before they deny my i751 ( the second marriage not the first marriage)

what if there’s an abuse what someone should do?

i was talking about my second marriage but if u mean my first marriage ( we broke up so early one month after i moved out here she left the states for internship and she stated 8 months overseas and she got in a relationship with another guy so when we had no any bona fides in the time between moving out here and the interview but i sent too many bona fides in the time between our marriage and moving here

all they care about is evidences evidences evidences so if u have evidences for abuse you should be fine

I have 2 leases and 2 tax returns and bills and picture and everything but she’s very crazy and things are not okay and I have police reports I’m not interested to marry after what I have been thru so I don’t want to get denied :(

@Alid - with that evidence you would likely be better off filing for a waiver unless you have documented evidence of abuse against yourself such as police reports, restraining order etc... The waiver will just need proof to show your marriage was binafide, I don’t think there is anything “hard” per se about getting it approved if you have the things you say you have

If you have a removal proceeding order, they most likely will deny your GC. You or your lawyer need to go to the immigration judge, and if they waive your case, the judge will start your adjustment of status application. You need a lawyer, for real.

@CA my lawyer plans to file motion to terminate before we can file AOS if they deny then I will with court, if approved then file with USCIS and I changed states. So looks like I have to redo a master hearing again. I did service request twice and the replies are pending interview schedule and Covid-19 delays.

@CA 2020 How did you file the motion of termination with DHS? What form? what’s the process?

@Pinky D your lawyer have to call the DHS and ask them to talk to the dhs attorney who was in duty in the day of ur court date so there is gonna be a discussion between ur attorney and dhs attorney but Idk what my lawyer emailed the dhs attorney he told me that he emailed them motion of termination idk if there is specific form or something
