hello juste had an interview few days ago and case I-130 was approved but I-485 the officer said need more time to review because of a paraphernalia case that she wanted me to admits at thé interview but my lawyer said no I shouldn’t because she’s trying to make me ineligible for approval any idea ? thank you

it’s was at a friend place a grinder was seen in the kitchen counter and I admits it’s was mine.

I was at the court for it the officer gave me a citation to show up at the court

Did you admit to it at court? were you convicted for it or paid any fine? if yes, do you have the court disposition? You might need to have the court disposition in case they ask for RFE.

What was the final outcome of the case? If they dismissed the case then you could probably get a clearance certificate from the court but I’m sure there might be other specifics. Wait on the outcome I believe your lawyer should have better prepared you for this, if this happened before you filed for AOS

I plead guilty for class b misdemeanor possession of paraphernalia and paid a fine of 400$ to the court.

at the interview i was with my lawyer and the officer read 2 law for me and wanted me to admit a use of substance etc and my lawyer advice me no to answer the question.

Did your lawyer know about this before you filed for AOS? because it sounds like your lawyer is misrepresenting you.

yea he submitted the entire case and I sent him my case sentence and police reports

Well now you have to wait on the outcome, good luck, I’m sure people have done worse and was still approved. Just have good thoughts about a positive decision.

I believe you will be approved, they might just go thru some extra reviews. by law, you need to have been convicted of either two misdemeanors or one felony to become ineligible. I personally know people with DUI that got approved. Did you get your EAD already?

thank you and not yet some how the interview came before the EAD and everything was good until she stop and asked me those question about the paraphernalia and said I’m gona approved the I130 but gonna need time to make decision on your I485 after my lawyer advice me to not answer those question that’s she’s trying to make me convicted of something that gona make me ineligible and denied

there’s not much you can do for now, just stay in touch with your lawyer and hope for the best, also you should try to expedite your EAD if you can or send a service request. Wishing you good luck

she told me she’s was going to approve the I130 and will need to review before making a decision on the I485 and thé next days the uscis updated my I130 as approved online I checked

Uscis will probably send you a letter asking for more evidence regarding your paraphernalia case.
Send all the information you have & the paperwork they gave you with the outcome of the case/disposition.
Be honest about it and don't hide anything from them.
I personally got a DUI 2 years ago & I am still on probation for it, had my interview about 2 months ago & the officer told me she couldn't approve me right away because they had to review my case & I also needed to provide them with more evidence.
I sent everything they asked for a month ago & a few days ago I got a notification " new card was being produced" so I got approved!!
I don't see your case being a problem what so ever unless your criminal record is really bad.
