EB2 Niw
Hi everyone, Re: EB2 NIW Did anyone have experience with this situation? We are in the States at the moment. My case status changed to : CASE IS READY TO BE SCHEDULED FOR AN INTERVIEW. 5 months after the RFE was submitted. The main applicants status hasn't changed yet, my case moved to this step(spouse) We were hoping that the interview would be waived. Thanks!

Your case is moving towards adjudication. After that, they will schedule your interview. What’s your FO ?

@Sepp Ps And a lot of cases were approved without an interview, they will just require proof of marriage. Haven't heard any case of denial though. Let’s see what happens next …

We went through the same situation, we sent the medical exams requested in the RFE and 4 months later the status changed to interview ready to be scheduled only for me who am the applicant and for my children, my wife did not get an update. Two weeks later the status changed to scheduled interview and a letter was sent with the date, the interview date was set for 30 days after receipt of the letter. We all went for the interview, including my wife who didn't get the letter but they let her in and held the interview. They asked her for a proof document from the school she studied before applying the EB2 and the next day we arranged everything and sent it. We are already 4 months waiting for an answer and until now. A real agony to go through all this.

@m g what kind of questions were you and your wife asked? was a smooth one? Maybe you guys/your attorney should follow up with a request. Best of luck!

It was an hour of interview for me where they asked all the dates since I arrived, where I entered, all the addresses where I lived. They absolutely didn't want to know anything about the EB2, it was more like a citizenship interview, the agent's focus was to find out if at some point we had lost status. He didn't find anything because I took all the extension letters that we had done and all the approvals between extension and my wife's student visa. He interviewed us separately, spent another hour with my wife and asked her the same questions, as she had a student visa before and he didn't have anything else to ask for, he asked for the only thing we didn't have in hand, something evidence that she had attended school such as proof of pay or grades or some statement on school letterhead. He handed her an RFe asking to mail it and we quickly arranged it with the school and sent it. The lawyers have already tried to find out about something, but they just say that now it really depends on the goodwill of the agent to get our case back. My and my children's status is as follows: interview is completed and case is being reviewed. Precisely because the agent informed me that my approval would depend on my wife's documentation, which we already provided. I hope to God this answer is brief and I hope your interview goes smoothly.

how was your interview @Daniela R ? I’m on the same boat with my wife
D RJun 21, 2023
@Sepp Ps @American Beaver Had my interview today. It lasted more than one hour. The officer went over everything, including proof of marriage and verifying the legal status in the Us ( my case was complicated, my third B2 extension was denied and I still had a pending motion to reconsider the case from 2 years ago). He went over I485 very quickly also asked for the medical records( I had a sealed copy of them, the originals were submitted in Dec 2022) My lawyer was there with me and my husband and his presence was very helpful. At the end we were told that everything looks good and we are almost approved, just waiting for the background checks and if our visa is current, which it is, we filed in 2020.

@D R did the main applicant’s status eventually changed to interview scheduled as well, or did you just go together regardless of the status change? My husband’s (dependent) interview got scheduled, but mine hasn’t
D RJun 27, 2023
@P H My husband's status, the principal never changed but he came to the interview and we both got interviewed at the same time, same questions 2 days later our status changed into : New card being produced. As long as you are ok with the status here everything should go smoothly.
