International Travel while AOS is pending
Hi, I have to travel back to my home country this December. I have my EAD/AP card. However, my legal contact at work is recommending that I avoid travel because if my GC arrives in mail while I’m abroad, I won’t be able to re-enter the country on the EAD/AP card. The explanation they’re giving is that once GC is approved, the EAD/AP card is invalid because I’m no longer an AOS applicant. But it’s not my fault that I don’t have control on the timeline - I can’t control when GC will get approved. Any suggestions? Has anyone experienced this situation before? Asked the same question to lawyers. You just need to mention at the Point of Entry that GC was approved while out of the country and show them the AP. That's the whole purpose of the AP. Another option is to leave mailbox keys to somebody you trust and ask them to mail you the GC if received while out of the country.
