Individual mandamus- i601A case approved
#i601a My husband’s case has been approved!! I601A (Nebraska) received 3/5/2020. I am so happy and so excited! After 4 inquires, multiple calls to USCIS and they were never able to give us any helpful info, 2 callbacks from two Tier2 agents who where very unhelpful, submitted an expedite request in January due to medical issues I’m having (it was denied). We decided not to join the class action lawsuit but after seeing that USCIS kept increasing the processing time in Nebraska and barely any cases were being approved, we decided to do an individual writ of mandamus. Our attorney said it was filed and accepted by the court on 5/15/23. Our I601A was approved yesterday 6/6/23 (approved in 23 days). This has been a long journey for us but we are finally seeing the light at the end of the tunnel!

@scaves Caves I called USCIS “customer service” number and to speak to a live agent you have to say info pass otherwise the automated system will have u going in circles. The agents that you speak to there are Tier1 agents and they can’t help you much because all they can see is what you can see when you look up your case status but you can kindly ask them to speak to a Tier2 agent because you are very concerned about your case and you have questions. I say kindly because some Tier1 agents are nice and others are rude. so once you ask to speak to a Tier2 agent they will put in a request and take your number to call you back. the Tier2 agent is supposed to call u back in 30 days. The first time we got a call back in 28 days and the second time it was in 60 days. speaking to a Tier 2 agent doesn’t really help though they don’t give you any helpful information either.

Congratulations to your husband, hoping it starts to move along for the rest. I have been waiting since Feb 3 2020. But my case was transferred to Potomac on Jan 20, 2023

@Billy Bob thank you!! My attorney is in Atlanta, GA and charged us $3k but I think it’s important to take into consideration that we have been a client for a very long time. We agreed that it was a fair price for us so we decided to go ahead with the mandamus. My husband will have his interview in Honduras. We have submitted all of the required documents to NVC and my attorney sent in a request for expedited processing to NVC and they will be notifying the embassy. Hopefully they approve and once we get an appointment date I’ll let you know.

@Carina S. I also filed the individual mandamus on March first week and yesterday my attorney told me that the state attorney told that they gonna file for motion to dismiss. I am so panicking now...pls help me... did you had this experience.

@N Vj sorry it took me so long to respond. So my attorney sent a threatening letter first to alert them that if they did not adjudicate my husband’s case by the deadline then we would move forward with the mandamus. USCIS never responded to that letter so my attorney filed the mandamus in May. the points that my attorney mentioned in the mandamus were… we had sent 4 inquiries and a congressional inquiry which USCIS never responded to and also pointed out that at that time we were outside of the notmal processing time because it was before they increased Nebraska to 44 months and we also pointed out that I had called USCIS several times and that we requested 2 call backs from Tier2 agents (they were not helpful at all, the calls were useless) and I was also having some health issues at that time too so all of that helped. Do you have any news on your mandamus??
