IMPORTANT // AOS & TAX DOCS FOR NVC
*** UPDATE 2: OUR SUBMISSION WAS REJECTED AGAIN! What for? Oh, my W2 form was attached to the same file as the I-864. Looks like we will wait another 2 weeks! This is a joke…
*** UPDATE 1: Today (19 Jul 2025), I submitted my resubmissions to NVC. I also want to note that Form 1040 is what we needed to submit, not the Form 1099. NVC requested a 1099 from us, but we do not have this, as we didn’t have extra income that was not wages from our employers. I hope everything will be correct this time. I will continue to update this post!

Hi everyone. I am making this post to share my current situation after submitting the required AOS/tax docs to NVC.
What I submitted:
• Form I-864
• Form I-864A
• 2024 tax returns for myself as well as my joint sponsor
• Proof of relationship to joint sponsor (a birth certificate)
The submissions were partially rejected.
Reasons why:
• Each form needs to be submitted with every page included, even if some are blank.
• Regarding tax returns, I personally submitted my 1040 from 2024. This was accepted! However, my joint sponsor submitted their tax return account transcript for 2024. Apparently this was rejected? Don’t ask me why lol. So, I am having my joint sponsor obtain their 1040 for 2024 instead. But we will still resubmit with both (account transcript and 1040).
• They also requested W-2 forms from both me and my joint sponsor. So we will submit those also.
I just wanted to write this post to make everyone aware so that a hold-up like this could be avoided. :)

wait you have to proof your relationship to the joint sponsor😥. my dads friend is my joint sponsor and I don’t t have proof of relationship to them😀

@. …. yes, it required this for me. it could be different for you though since my joint sponsor resides at the same address as me. maybe you can submit a pdf with pictures of you and his friend + a proof of his address and occupation to show that he has lived/worked in the US for a while. you can also send an inquiry to NVC if you need any further information about it. maybe it is not required for you, but it showed up for me. I thought it was kinda weird…like shouldn’t the tax stuff be enough? Best of luck to you 🙏🍀 this process is a nightmare.

@Mariana ♡ Yes, it’s a nightmare. First, the NVC didn’t send me the welcome letter. I literally had to chase them for it, lol. It took me two weeks. Then my preparer is driving me crazy, calling me every second for things I’ve already provided, yet she keeps claiming I didn’t. Hopefully we’ll submit everything tomorrow. 😵💫

Oh wow, it sounds like our experience with USCIS. They even told my local congressperson that they couldn’t locate our case. Then suddenly our I-130 got approved? Were they lying?
We have experienced similar issues dealing with documents. The workers at the notary, apostille, and translation offices can be irritable. And my husband struggled getting all of his civil documents. He had to travel all over his country, especially for the criminal history report. And then we ran into issues with these people giving us the wrong type of apostille seal and whatnot. We have both been running all around nonstop because there is always some minor thing that is not correct. And then there are all the different rules in other countries so it’s overall been a big mess. My husband is also one of the European countries that was transferred to Frankfurt, Germany. I forget what the reasons were for all of that. I am with him overseas currently, in hopes that I can help him prepare for his interview…if we ever get to that stage any time soon lol.

@hi new We printed the signature page out (from Form I-864A). She signed it in ink, and I scanned it. Then I combined the pages into one PDF file.
NVC will reject electronic signatures. I have heard of others having to resubmit if the signatures were not done by hand with an ink pen.
The same goes for Form I-864. I signed it by hand with a pen and then scanned it.

@Mariana ♡ oh wow gurl you’re amazing because I’m losing it right now. Thankfully my husband got his criminal record on the same day but I made him redo as the English translation was all over the place.
with uscis did you file online or papers? because that’s weird of them to “not locate it” especially if you file online even papers. my case was scanned and tried electronically. Things don’t vanish lol. But so happy for you that you got approved.
and for the joints sponsor did you have to print the whole I 864 or just where the joints sponsor needs to sign?

@. …. Yes, we also had issues with our translator! 😅
We filed online with USCIS. Yes, I was confused when the assistant at my congresswoman’s office said they told her they couldn’t locate our case. I can easily
track it and log into our myUSCIS still. I think they just didn’t want to admit to being lazy. It made no sense.
The joint sponsor has to sign a separate form (I-864A). Yes, the message I got from NVC was that every page of the form needed to be included in the submission. Pages 4 and 6 require signatures. My joint sponsor is a household member so it may differ if they are not a household member. I am not entirely sure.
Interpretors and preparers also have to sign (page 7), if you have them. We do not have either, but NVC still requested that we include this page, even if it’s blank. The page with “Part 9: Additonal Information” must also be included in the submission (even if it’s blank too).
It’s a lot. 😅

@hi new You are welcome 🙏 we will have to resubmit our stuff to NVC, and I will post another update if we will get DQed!
For the I-864, the sponsor (petitioner) must make 125% of the HHS Poverty Guidelines (this is for a household size of 2). On USCIS website, the amount says $26,437 annually.
If you are in the military, it is 100% of the HHS Poverty Guidelines.
Hawaii and Alaska are a little different with annual income requirements.
If your income is below the required amount, they want you to also submit Form I-864A (joint sponsor).
I will update if ours is DQed. They need me to resubmit my joint sponsor’s 1099 Form as well as their W2 from 2024.

@. …. They requested that we submit the entire I-864 and entire I-864A, regardless of any pages left blank!
I just submitted my resubmissions this morning. Hope all is correct this time. I hate how it pushes us back in line. I can’t imagine it being incorrect again…we’re already in the middle of summer.
I actually just figured out that they probably didn’t notice my joint sponsor’s tax transcript bc I had it attached to the I-864A submission. I submitted all tax docs separately this time bc I think they didn’t notice it when it wasn’t in a file by itself. Who knows. 🥲

@hi new Our I-130 took 1 year and 6 months until it was finally approved. We also had to deal with an RFE.
We have not yet been DQed by NVC. I just resubmitted docs to them this morning. I will update when we finally get notice that we are successfully DQed and transferred to the foreign consulate.
My husband is from Slovakia.

@hi new Our marriage document needed to be translated to English!
I had to contact my local congressperson because we submitted the certified translation shortly after and USCIS decided to take almost 3 months to review our case again…
It makes no sense how they will make you wait so long to be approved then you get an RFE and they make you wait months again lol.

@hi new yes, if you have documents in a foreign language, you need to have them translated into English. I translated everything, and the translations must be certified. You cannot just translate them yourself they have to be done by a certified translator or translation service.

@hi new Done by a certified translator at an official office. We also had notary and apostille services. The certificate has to have a seal on it or stamp. Authenticated basically.

@hi new A translator is available at local offices wherever you reside. You can do a Google search for one in your area! Same for the notary and apostille. You have them locally. Some documents may need a larger apostille. For example, my husband had to travel to his country’s capital in regards to the crime history document that NVC will request. The others can be done locally usually.
To apply for a blue card in Europe, I had to get a crime history report (locally in my state), but I could not have it certified in my state. I had to travel to Washington DC for the authentication service. When I arrived in my husband’s country, we had the crime history translated to his language, and certified there. The process is pretty much the same.

@hi new The petitioner and joint sponsor (if you have one). I would still bring the foreign spouse’s tax information to the interview though. But in the NVC account, they did not ask me to upload anything about my husband’s tax information. Only my joint sponsor and I had to upload tax info.

@mario brown 2 weeks after our first submission. We are still waiting to hear back regarding our second submission. It will probably be 2 weeks again which will make it August 2nd.
