I’m back to JFK with Advance Parole / Pending VAWA
Hi everyone,
I would like to share my travel experience for those who keep trying to find an accurate information.
I got my combo card based on my marriage for two years, then I filed VAWA & divorced. My 2 years valid card is going to expire next month. I haven’t receive my combo card based on VAWA yet.
On my last arrival the officer admitted me as LPR and before I leave, I went back to CBP office and ask them if they can fix it, so that I can have a valid I-94 record. They fix it and void my LPR stamp on the passport.
So today, 45 minutes ago, I landed to JFK from a Schengen country, it was quick line, took less than 10 minutes. When I was in front of the officer, I gave my passport with my combo card.
He didn’t ask me anything, the only question was if I have any alcohol, tobacco etc. I said no. he left from his desk and told me to follow him, we went to second inspection room together. I just sit like 4 minutes, I was really nervous for a second but they all seem so friendly and kind. So officer gave my passport to another officer at the inspection room and he left, they didn’t talk either.
The new officer probably checked my prior arrival record and if my I-485 is still pending, he stamp my passport and wrote paroled until next year.
All process took less then 10 minutes, no question, no conversation.
So, if you have a valid advance parole with a pending I-485, (I don’t have a prior over stay or criminal record) do not hesitate to travel but of course always ask your lawyer.

my mom travel through jfk too 2 weeks ago had the same experience I think it’s best to travel at night officers don’t penalize you that much my assumptions thank you for your experience @Ivan b

@Ivan b do you hold European passport ? if not then how did you get the Schengen visa ? I want to travel Europe but need visa . so I want to know th le process

@Ricky Jose You can get a visa with AP card. I got one UK and one Europe.

@momo hamilton, did she used and came back safely, was she in removal proceedings or perhaps did she cross the border or came with visa and overstayed.

hello Ivan my visa expired and I have a new passport can I travel from my home country with combo card or I need to go to embassy and get visa back in my country first and then should I travel any one can you please answer this question

@ال وقت she came with visa 2016 was never in removal proceeding she went to our country for a day once she came back to jfk they brought her to a secondary room because they did not have the stamp for her passport they ask her a how was her trip and what was it for and that was it

when you said you don’t have a prior over stay record, what did you mean?
what I think I understand by over stay, is when we were given US visa, we over stayed right ?
is that it?
if yes. thought they usually waive it when filling after marriage.

@chris rod If you have a valid combo Card why do you need visa? combo card is like next level, initially you have visa, and you apply to an immigrant process like getting married etc after that point I don’t think that visa is still the right document for you to use. I still have valid tourist visa but that doesn’t mean that I can use it.

@pinky AK 2 weeks. I believe you can, the only point is if USCIS wants to reach out to you or send you a document or schedule an interview etc you have to be back.
over stay means, let’s say years ago you came with tourist visa and 6 months experied but you didn’t make it extended and kept staying and got married 10th month of your stay and based on this marriage you have AP, some people worried if it could be a problem on arrival.
if you ask me, USCIS already now that you over stayed and as far as I know AP also can be given to DACA people. So it doesn’t have to be only based on marriage or VAWA, and DACA people is over stayed already. so i think it’s safe. Even in you have a problem on arrival, as far as I learn, officers schedule a request or something like that for you to go to USCIS office for further actions on your arrival, it’s not like sorry you can’t come in and bye, of course if your I485 is still valid.
I checked thousands of pages, paid 5 different lawyer to get their opinion they all talk negative in general and said it’s dangerous but CBP officers are really nice in general, if you have a valid card why they should say no you can’t come in
