Generally, a denial of a VAWA petition does not automatically or immediately trigger issuance of a Notice to Appear (NTA). USCIS issues NTAs only in specific circumstances, typically where the individual is removable and does not have another lawful basis to remain in the U.S., and issuance is subject to agency enforcement priorities and internal review. After a VAWA denial, there is no fixed timeline for NTA issuance, and in many cases, no NTA is issued at all unless the applicant is otherwise removable and not in another protected or pending status (e.g., pending I-485 or appeal/motion to reopen). Under current USCIS policy, cases involving humanitarian filings like VAWA are generally subject to discretionary enforcement review rather than automatic referral, meaning timing varies significantly and depends on individual circumstances such as prior status, criminal history, or presence of other pending applications. If you remain without lawful status after the denial becomes final, you may receive an NTA within 45 days.
