Hello fam, I have a question about I864.
I recently submitted form I485. My stand-alone I130 has already been approved last October. I am on STEM OPT, hence have a work authorization already. I am married to a USC. I am employed and my income is higher than my husband. I’ve included our 3 last joint tax returns, my paystubs, and employment verification in my application. Now, my question, did I still need to include I864? if yes- can I just add it to my online account under unsolicited evidence?

@A Johnson As per the US government it doesn’t matter how much you make it is all about the USC. Submit his income information and if he doesn’t make enough you will have to get a joint sponsor.

@My P doesn’t our tax return indicate how much he makes? does that mean I have to submit I864, too?

you still need to do the 864 and attach his W2s and paystubs. I also make more than my husband but he still had to sponsor me. and you definitely need the form. @A Johnson

@A Johnson You mentioned you included your paystubs but the i864 is only how much your spouse makes. I think it is ok to add it to you online account.

you certainly need to file I-864, and you can certainly use your income. On the i-864 include your income and if you filed joint tax returns your income is considered his for the "total income"

you should include your tax return transcript with I-864 and no need to send in W-2. You already included bank statements but you can upload it again with the I-864. And you should best mail the I-864 because it's not considered unsolicited evidence, it's a required form. attach a copy of your I-485 receipt as well

according to the instructions, intending immigrants income can be used in certain conditions especially a spouse
