My husband got final divorce after he filed taxes of 2022. So, in the 2022 taxes he still filed as marriage with his ex-wife. Now, we got married and he wanted to do AOS for me. My question is
1. For I864 that we have to send the individual Federal income tax return from my husband back to three years , do we need additional documents to explain because he always filed jointly with ex-spouse including last year 2022 before divorce?

definitely have to include the statement explaining the situation, when send out your package you should include a cover letter explaining this

I was on the same situation but I haven’t sent any explanation just the correct information , sometimes they know that divorce may happen after a while. I got my divorce decree back on Dec 2022 and I submitted my current wife’s AOS on April 2023 and the progress on the case is amazing just waiting on decision. PD: I have submitted strong proof of good faith relationship.
