i751 waiver
I have a conditional 2 year green card, weโre however separated and I want to file for a divorce and apply for my permanent green card through a i751 waiver based on abuse as he has been very abusive. my question is, I know the process might take a minute and I want to know if I can get remarried after filing the i751 waiver due to abuse while it is not yet approved. can I get remarried to someone else while waiting for my i751 waiver decision?

Iโm really sorry for whatever u went through. I believe nobody should stay in an abusive relationship. that said, in this situation I will advise u to take your time before u get in another relationship. I bet u the first, meaning the one ending now , was really sweet in the beginning. so take your time now before u get yourself in another, that will probably not last either, because trust me the beginning of every relationship is great. Ok back to immigration, put yourself in the shoes of the officer working your case. letโs just assume for a second that u are one of the luckiest applicants and your application was approved in 45 days ( u have a conditional GC ) . Meaning u have been married less than 2 years. Now u filling for a divorce waiver. ( I-751 ) . And while waiting for that to get processed, u get married to someone else. Now as an immigration officer, what are the questions that comes to your mind ? Was this marriage real ? Or was it just for some immigration benefit ? Are the claims of abuse real or just made up ? When did she gets the time to know the new husband ? Or were they in relationship already while she was still married to her ex husband ? Is she marrying this one just in case the waiver doesnโt work ?
These are the things I will look into if I was the IO .

these are situations that put these officers in a suspicious position that eventually affect even the genuine marriages from fake.
how can someone even contemplating of doing this??.
this is a typical red flag...do so at your own peril.

@dunnnnn kkkkk Thank you so much for that observation. I honestly just had a question and wanted to know how possible it will be for me in the long run. I havenโt even met anyone else or thinking about getting married yet. I just wanted to know if I had that option paraventure I meet someone as I know the process might take about 2-3 more years for a final decision. is that such a bad thing to want to know? @Peniel Kay

@felasky God is good ๐๐๐ thank you so much. I have actually been married for almost 3 years now and weโve been separated for almost one year(not legally), he moved out. I understand your concerns and perspective but it was a honest question. I was just trying to know my options, seeing as I know it might take a long time for me to get a decision. I am not seeing anyone now or trying to get married, it was a question to see and know what my options are when that time comes. But then again, thanks for your breakdown.

@Ollie Manta I'd say you should focus on lawyering up for the other interview. Clearly your husband will not be a part of the other interview which may cast doubt on the marriage so before that time comes, get your paperwork and evidence together because now you'll have to prove the marriage was bonfide and it broke down after the fact. Even if you meet someone now, date if you want but don't introduce marriage because you might just make things harder for yourself. If you have proof of abuse as grounds for a divorce, then go ahead and divorce. That will be public record and help you when the time comes

I gave an honest opinion based on your post seeking advise,it may appear harsh but no,its not...but a reality check.
we should be well guided when making a move like this as a genuine intentions might be construed as being suspicious.
I have a family friend who failed to secure any immigration benefits for years now due to many past marital complications.These people keep records..

@felasky God is good ๐๐๐ great response. I think they look carefully on these things. They took over 18 months to approve my conditional green card five days before our 2 years anniversary ๐๐๐. So I do think will inquire more if you divorce and remarried with a short span.
