I751 Potomac !
Good evening guys, today I feel very sad, on Monday I received the divorce decree. My I751 is pending in Potomac I filled in March 2021. Does anyone have a sample letter to inform USCIS. Thank you for your help my English is not very good.

@Rocco Forté I have a question you might have an answer to enlighten me. I’m going to file for divorce next week. I have a pending i-751 since November 2021. I have seen cases from August and September of 2021 from the same service center as mine being approved this month so it means mine is supposed to get a decision soon. I talked to a lawyer today and it seems like in my state de divorce takes about 7 months to be done. I’m really worried if they request the divorce decree and I don’t have it in time. Do you know what are my options ? thanks so much!

@M G You are in that grey area with USCIS. Question is, are you still considered married while your divorce is pending? To me I think you still are but USCIS might think different. What I’d do in this case is that since your divorce is yet to be filed, you will file it then inform USCIS that you just filed for divorce and will provide the decree as soon as you have. If they issue RFE then you respond with documentation showing that your divorce is still being processed. It can go either way, they might drop your case till you send in the decree or they will deny it. If they deny your case then you just have to start afresh as a waiver case. It’s sad but better than deportation. You need to speak to an experienced lawyer in this case. Is there a chance you can hold off on your divorce?

I could wait to file for divorce. But I have no chance to go to a second interview with my husband in case they invite me to another interview. do you think if I start to file and hold off until I get the decree is wrong ?

@M G Did you submit a very strong I-751? It’s the strength of your case that will determine. If you were gonna have an interview, they would’ve transferred your case by now.

I sent: rental lease agreement for the whole period of the marriage under our name, renters insurance with both names, tax transcripts filled married jointly, car insurance showing both names as insured, car registration showing same address, I also sent the post office notification (letter) for changing our address because we moved once, AAA joint membership, check for both of us for the credit we received from irs from the pandemic time, a letter from the White House we received from the pandemic time addressed to both of us, bank statements for a checking account that he is added as joint owner, 2 affidavits from friends, boarding pass from the trip we made to Brazil when he went to meet my family and very few pictures including for the time we were with my family in Brazil. that’s what I think I sent. what do you think ?

I also sent some T-Mobile bills were it only had my phone number under his plan. idk if they will consider that as it’s only under his name and has his old address as he never updated with T-Mobile I think I shouldn’t sent that one

I have another detail on my case. when I got married I got my husbands last name. As pandemic happened I never proceeded with changing all my documents and ids to my married name. I ended up deciding to keep my name. so all the documentation sent was under by name from before getting married. the only document that contains my new name is my green card and marriage certificate. so idk if that would be a reason for a second inspection.
