I751 interview scheduled, spouse not willing to attend
received I751 interview scheduled next month, but spouse not willing to attend. had married 5 years, now separated. Any suggestions what shall I do next?

@ratatan loquera You’re eligible for VAWA when you can prove abuse by your spouse. You can’t just file VAWA because your spouse refused to attend your interview.

@Johnny Zhang if you filed joint, it is required to go with your spouse unless you have devorce decree to submit. I would recomend getting a lawyer.

If your I-751 was filed jointly and your spouse refuses to attend, do not skip the interview. Under U.S. Citizenship and Immigration Services rules, a missing spouse in a joint case can lead to denial if you do nothing.
Since you’re separated after a 5-year marriage, you should attend the interview and request to convert the case to an I-751 waiver based on divorce. If possible, start divorce proceedings before the interview and bring strong proof the marriage was real, such as joint taxes, leases, bank accounts, and photos. Given the risk at this stage, speaking with an immigration attorney before the interview is highly recommended. Since this is a high risk case, you should definitely meet with an immigration attorney before making a move
