@SK SK what would you like to know? I am on EB1 with PD Oct 2022 and EAD. I have switched jobs using AC21 from L1A. the process is smooth and you just need to be aware of 3 things- 1. the 485 has to be pending for more than 180 days 2. the job classification or SOC code has to be the same when you switch and 3. the company has to be viable

what if rfe comes for i485 will new company be able to help in rfe?

@RW BM yes I did file a 485J and travel has been smooth. just make sure that you add a little extra time for secondary inspection but questions are easy and they process I94

thank you so much @Regular guy! who has to file AC21 and when? is it before accepting the offer or later and do I need to hire a lawyer to do so regarding your points . 1) Yes, pending more than a year, 2)Job responsibilities are more less same but title is has senior added in it 3)Yes, the company is obviously viable :p

@SK SK you will have to file 485J. AC21 portability is the rule for porting jobs. you will need to file this after you join the new company. there is no defined timeline to file it but the sooner the better. Your new employer will need to furnish some information and maybe some documents like audited financial statements but it’s best to use a lawyer. I filed using a lawyer. All the best and so long as you fulfill the criteria do not worry at all

@sai and @sk.. with EAD on hand but within 180 days of filing aos can you still change your job?if not I don't understand the point of EAD ..so EAD+180 days is only valuable,not EAD alone..am I correct?

@Sai Dev @Regular guy won’t 485j alone be enough? I don’t think additional documents are needed from company. also do you get an receipt notice or status for 485j ? usually for RFE response or on day interview, we ll know that it is being acknowledged by uscis

@a k my lawyer had drawn up additional documents from the employer. I am not sure myself if all that is required but better to be safe than worry. I did receive the receipt from uscis.

@huber Manu for company petitioned 485, the 180 days clock matters to use EAD for primary but secondary applicants can use ASAP.

@a k i responded to an rfe with 485j and the rfe cleary mentioned a bunch of documents (w2, payslips etc). i did recieve a reciept notice for 485j. Afterwards my case was sent to CRP.

@Sai Dev why did they suddenly issue an RFE? did they end up figuring out that your current visa (like h1 or l1) was revoked by the original employer who sponsored the EB petition? I thought only when they decide to work in your case that’s when they realize all this, but in your case they anyway parked the processing to CRP status.

@Regular guy hey had a doubt, so my employer filed my i485 and i485j together back in 2022 so far my i485j is in status as fee waved off… no update since then. so if I file another i485j for the new job will that have any impact.

@a k afaik after 140 approval sponsor company does not sent a revoke request for l1. So i doubt uscis have had a clue about my change of employment and l1 status being invalid from what i could figurebased on my enquiry back then). i was already > 180 days out from concurrent filing date and my 140 was in approved state. My 485j is approved but im still unsure if the case will get picked up in next quarter unless the dates move (my PD is dec 22)

@Regular guy @Sai Dev hi both just wanted to confirm if you had the same SOC code? my new employer is saying there is 50%or more match in job responsibility but they usually use a different SOC code so will mention the other SOC code. would that be a problem

@SK SK not sure about this myself. it is best to seek an attorney’s advice. as far as I can tell the SOC code has to be same

AFAIK SOC code should not change or you need to inform uscis. suggest you to reach out a lawyer. Also generall similar job profiles have same soc code (uscis has soc code list somewhere in its website with job titles). possibly ur employer has little idea about soc code. pls confirm with a lawer to be safe.
