i485 EOIR transferred in the process to USCIS
Please does anyone knows how long will it take for the i485 to be transferred to USCIS. I had filed the i485 with the immigration court since 2019 and there wasn’t any movement but to show the fingerprint on this application. Does anyone knows how long it will take to get with USCIS so that I can get an interview
my i130 was already approved with USCIS during the removal proceeding and now we are finishing the i485 after the immigration court terminated the proceeding.
does anyone know if I should file the i485 or how long will I have to wait. all the document were sent to USCIS since 27 th of January is what my lawyer told me. so can any one provide any helpful information please 🙏🏾

no I am trying to transfer my case i485 that I was in court to USCIS for an interview instead of filling a new i485 with USCIS

I filed a i130 with USCIS during the removal proceeding but didn’t include a i485 at the time in 2019. now I’m trying transfer the i485 from court to USCIS

did you went to the court with your approved I-130 and then ask the judge to cancel proceedings against you and now you want to file I-485

my attorney went to the master hearing than show the i130 approval and couple weeks later ask the DHS attorney to terminate the proceedings which took couple weeks. than case got terminated and dismissed @Jo Long
During the removal the i485 was filed with the immigration court, I never filed with USCIS. now my attorney is planning to transfer the i485 from the court to USCIS so that we can get the interview.
I asked my attorney will be okay to file a NEW i485 with USCIS he told it is not recommended as the i485 is in the middle of transferring since the 27th of January 2023… Hopefully this go thru quickly without waiting too long.
did anyone here transferred their i485 from the court to USCIS??????

@Baltimore you and I have the same time frame my case got dismissed July 2021 my case was transferred from the court June 2022 to my fo I get my ead also in june I also file i485 with the court

filing i485 with the courts mean the judge needs to adjudicate your case. I would of never filed with the court. also when you send the motion to reopen why didn’t your lawyer let the judge know you had a pending i485 with the court?? @Baltimore 410

@tas smith yup, that’s it. how long it took the Texas service center to send i485 (Eoir) to National Benefit Center? did you had to call the USCIS number couple times ?

@Baltimore Texas only send it to my fo after dismissed but it took them along time I never stop making inquiry that's how I knew it was at my fo now fo say to give them another 120 days for rfe are decision

don't call you will not get the correct answers they will tell you your case is in texas with fingerprint when infact its at your fo make inquiry under your status they will reply to you in about 10 days then you can see which office the reply came from that's where your case is

don't refile continue with the one on file your case won't go to the Nbc it will go to your fo that's where you live make inquiry about your case

I am at Baltimore so if it’s not at the field office for nation benefit where it would be.. I thought just send it to any center and let the fo. maybe I got it correct can you tell me how this work please?

Baltimore when you file i485 with the court it goes to texas service center if the court don't make a decision on the i485 it goes to uscis to your field office it won't go to the nbc you need to make a info pass and bring your paperwork from the court to your fo then you will know exactly where your case is are make an inquiry

your case can only be at texas are your fo your status will only say fingerprint applied to your case and it's at texas service center which might not be the case like mine we have the same status but my case is at my fo which is why I said your's might be at your fo

it might be to be for real, because I just now got off the phone with court and they told that they sent everything over to DHS or to the field office but I’m not sure if she knows what she talking about, my attorney said that it should be at USCIS and he just waiting to get a confirmation on their end to make sure everything is receive, hopefully it’s doesn’t take a long time 🙏🏾@tas smith

your case at the fo DHS is where your fo is when I made my inquiry they reply from DHS and that's where my fo is it tells you forget the lawyer I had to tell my lawyer that my case is at the fo then she confirmed when I send her the email I received

I’m in similar situation. my removal was terminated in June 2022 and I have been waiting for the court to transfer to USCIS. i reached out to congress women and she received a response from USCIS regarding my case. it stated that they r still waiting for my case to be transferred.
back in October 2022 I made an infopass appointment and brought the termination letter. they said wait for 30 days and still nothing. I called them like 5 times and they said no updates in the system. they don’t have the termination letter updated in the system yet.
I sent a written letter to FO and Texas service center with I-485 receipt and termination letter two month ago and still nothing.
my lawyer sent a letter to the court, to see if they can send my case over to USCIS, still waiting. it’s been only a month.

@Baltimore 410 did you resolve your case? We are in the same boat where it seems that no one knows who has my A-File and my attorney is still checking for the past 3 months
