expedite your mum’s case. while there’s no guarantee, there’s no harm in trying. Also, the answer to your question is NO. Your mum can’t apply for a visiting visa with her I-130 pending

I have entered the us on a visa waiver (Esta) while awaiting my I-130 case. planning to do so again in a couple months. just if approved while there she will need to exit and reenter the country through the visa. we checked with our lawyer

@Oumou. I’m also in the US currently visiting my husband. I used an ESTA. You can apply for an ESTA depending which country your from and it’s not eligible for every country

Having an already approved ESTA is very different than applying for a visitor visa. My wife has been able to visit with an I-130 pending because she has long had a valid ESTA. But if she were needing to apply for a visitor visa, it’s likely she would be denied because she has shown “immigrant intent” with a pending I-130.

@No Dice thank you for corroborating my point. while the I-130 is pending, you can’t apply for anything to come into the United States. That’s all my response said.

I entered on a visa waiver because I’m from Australia. maybe if you don’t qualify the consider your case more at risk. I literally had no issues though. I would contact a lawyer though.

just as a point too I applied for my esta (waiver) after my I-130 application was filed.
