Three years for an I-290B on an I-140 is far outside normal timeframes. Motions to reopen/reconsider are supposed to take a few months, and appeals to the AAO often take longer, but 3+ years is considered an extreme delay with U.S. Citizenship and Immigration Services. At this point, you should not just keep waiting. It’s important to confirm whether your case is a motion or an appeal, and whether it’s sitting with USCIS or the AAO. I strongly recommend having an experienced employment-based immigration attorney review your denial and I-290B to decide whether to escalate with a congressional inquiry or mandamus action, or whether filing a new I-140 would be a faster and safer strategy. - Attorney Ana Gabriela Urizar (All information shared here is for general educational purposes only.
