i140 RFE Ability to Pay
My i-140 was filed on 30 Dec 2022. As I filed the i-140 in 2022, 2021 tax return was submitted. My employer sent a partial 2021 tax return to the lawyer, maybe that is why RFE is issued. The RFE letter was asking for full tax return 2021 to prove that the company can pay the proffered wage.
But since the RFE was only asking for tax return 2021, I was wondering if I need to provide tax return for the PD year as well (2022)? The net income on the 2021 tax return combine with my current wage (less than PWD) would be sufficient to prove that the company has the ability to pay. I am asking because my company is doing not too well in 2022.
Has anyone encountered the same problem? Could you share your experience? TIA!

My I-140 was submitted with 2021 tax return in Jan 23 and was approved. I'd send full 2021 tax return. I personally work in the accounting department and we won't file 2022 taxes untill mid of 2023 (it's a mid-sized company). I believe the 2021 report will be enough. Most companies haven't even started working on 2022 tax reports yet.

How much income should a company be reporting to sponsor someone?

Per my understanding If a beneficiary is already on a company's PR the company should make a breakeven but not loss. If a beneficiary is not on company's PR net income should be more or equal to a PWD.

Thanks Night Fury, can you be self employed to submit your own i495J supplement if you have secured contract with similar job approved on your i140 which has been pending more than 180days?
