I140 EB2-NIW premium processing request while on RFE review
Hi all,
Is it possible to request premium processing for my i140 EB2-NIW while USCIS is reviewing my RFE response?
I have sent the response 32 days ago and still haven’t heard from them.
As background information the RFE questioned all three prongs and my attorneys believe the officer might have confused with something else since all the requested documents had already been sent.

All 3 tests, they did not ask anything specifically either, my attorney put together 180 pages response, we sent additional publication copies with it.

I’ve just upgraded to PP after my RFE reached 82 days. I saw people over 150 days waiting for RFE responses… I’m done with it. People and lawyers will say this doesn’t make sense as if anything related to USCIS would make sense at all. At least now the clock is ticking on their side… My Pd is May 2020…

lcbrj 777 just for the records my RFE was just to submit a new G28 Form! I would expect to be pretty straightforward to check and make a decision.

@liberty statue USCIS said the G-28 was improperly completed. However, my attorney listed the I-140 on the G-28, which is what the RFE said was wrong, so the RFE isn't even accurate.

My case status changed today (15th day after upgrading to PP). It now says: “Notice Explaining USCIS Actions Was Mailed”, which I’m interpreting as a NOID (I will make sure when the letter arrives through mail). I’ve created a new thread below:

I have waited for a decision after 70 days of RFE response. I upgraded to PP last week. receipt for the PP was received yesterday. 6 days after PP today. no final decision yet. please let me know if you hear any news after the upgrade.

I upgraded to premium processing and around 10 days received final decision (approval). That $2500 saved me from lots of stress. I also started my new job after having EAD and I40 approval. Hope you hear back soon
