I140-EB1 approved
Hello everyone, Posting my I140-EB1 approval, because I’ve been an almost silent member of this community but got a lot of insights/value from it. I filed concurrently I-140 NIW and AOS back in June/21 and had an RFE in July/22. Decided with the lawyer to petition for EB1/PP before answering the RFE. It paid off. I have a strong feeling that our response to the RFE would also be approved but I strongly believe that the EB1 criteria are way less subjective. Meeting the 3 required criteria is a much more binary decision than discussing national relevance and other prongs for NIW. Wish you all best of luck!

@Ricardo D. oh I though your I-485 was approved. I read it wrong. We have a similar case. Applied concurrently for an NIW in March 2021, and then applied to EB1B with PP on April 2022. Both are already approved, and we’re waiting for our Interfiling. But we’ve noticed that the applications that filled a new I-485 in 2022 have had faster answers than the interfilign. But as with everything with USCIS there’s a lot of luck in the middle. Sometimes paying the fees again it’s with it

@J P, I see. As I recently receive the combo card, I didn’t even consider to file a new I-485. What you call interfiling is a letter to USCIS informing request the AOS to use a different I-140 approval, right? Is there by any chance a specific form for that? My lawyer told me that there isn’t.

@Ricardo D yes there is a process, it’s officially called “transfer of underlying basis”, informallly Interfiling. You have to send a form I-485J to a new California office that is only for Interfiling. You’ll receive a receipt for That form, but not the Interfiling per se, since that is an administrative process inside the USCIS.
