I131 DENIED DUE TO OLD AP
Hi everyone, My new I-131 was denied. The denial letter clearly says it’s because I already have a previously issued Advance Parole valid until 2029. The problem is that this old AP is tied to a prior I-485 that was withdrawn (USCIS received the withdrawal, but never updated the status). Now I’m stuck: If the old I-485 was withdrawn, the AP shouldn’t be valid. But USCIS denied the new I-131 saying the old AP is still valid. Has anyone had this happen? Did you file a motion or just reapply? Did you travel with the old AP in this situation? Thanks in advance.

maybe your old AP still working. I have a friend that withdrew her VAWA due to her new marriage and she still uses her old work permit +AP from her old application

You are right that advance parole is only valid while the underlying I-485 is pending. If your old I-485 was properly withdrawn and processed, the AP tied to it should no longer be valid, even if the card shows an expiration date in 2029. The denial of your new I-131 likely happened because USCIS’s system still shows that old AP as active. It is generally not safe to travel on that old AP if the underlying I-485 was withdrawn. The cleaner approach in situations like this is usually to refile a new I-131 with a clear cover letter explaining that the prior I-485 was withdrawn and attaching proof of the withdrawal and the denial notice. If travel is urgent or the facts are complicated, it is very wise to have an immigration attorney review everything before you rely on that old AP. - Attorney Ana Gabriela Urizar If you have any other questions, feel free to ask them in our next Lawfully office hours session!.
