I130 evidence IR1
my husband filed my aplication online and only attached the documents required without any additional evidence of our marriage. shouldn't we have attached the evidence of our marriage along with all the documents? our lawyer says there's no need and we should wait for USCIS to ask us for evidence. is that true?

yeah you should add it, if you get an rfe it’ll delay your case you can add the case on your account and it’ll let you add “unsolicited evidence”

You can upload additional documents as proof of marriage under the “unsolicited documents” section on the bottom of the USCIS case documents page. I submitted additional evidence of marriage multiple times before our I-130 was eventually approved.

Unlike the NVC, submitting additional documents to USCIS doesn’t reset your priority date/place in line

example: this lawyer we went to because my sister in law had a tourist visa since she was little then they lawyer scared us saying they’re going to get denied and next thing you know she had her interview a year ago and the officer didn’t even mention the tourist visa which was in the docs they uploaded
