I wish he could visit while waiting
I am a US citizen living in the US, my husband is Irish, lives in Ireland. Our I-130 stand alone is still processing, but while we wait I wish more than anything he could visit me in the US. I have been able to go to Ireland to visit him a couple of times for a few days, but with 2 kids and a job, it’s not easy. He has tried several times to get a visitor visa to come over, every time it’s been denied. They have him to go to the Dublin embassy, pay a large fee to be told no in less than 30 seconds, they don’t even let him talk or show documents stating why it’s important to visit, they just look at him and say no not today, you can apply again and pay another fee. We live on FaceTime phone calls together, constantly in contact, this is so so hard. I miss him, my daughters miss him. I guess I understand when they say a spouse isn’t likely to get approved to visit while a visa is processing because they’ll probably not go back and overstay their visa. But why would we let him overstay when we want the green card, we wouldn’t jeopardize it. This is so frustrating. #i-130 #marriagevisa #visitorvisa

just get an esta and get him to visit for 90 days or less while you wait?

how come he’s getting denied? if the i130 hasn’t been approved yet it shouldn’t be flagging his passport? :/

@Amanda Paddy It's a big mistake to let him apply for a visitor visa... HE WILL NEVER BE GRANTED FOR ONE. The reason is because he already have a case pending. It's a waste of time and money. You should have let him come here first with a visitor visa and then apply for Adjustment of Status while he is in the States but since he is abroad, he has to go through the NVC.

@Jacob N It is a waste of time and money.

@Jacob N I don’t know exact names of visas😅 yes he’s applied for esta

@BAYANO PARKER he came to the US for his first and only time a couple years ago on an esta, which is when we met. The time was up on visit visa to go back to Ireland, so he did and hasn’t been allowed back since. Trust me I know there’s so many things I wish I knew know back then and would have done differently. Immigration, visas all that is ALL new to me.

I understand your pain, sort of. My husband lives in Canada and hasn’t been able to come visit since he left in May 2022. Fortunately traveling up there isn’t too difficult so I’ve seen him often the last two years. I definitely wish I knew more about adjustment of statuses and such before starting. Almost two years in and we’re still waiting.

what is your priority date

Same exact situation with my wife. We also applied in April, and the wait has been excruciating! Hopefully we’ll all be receiving good news soon

I’m in Nigeria 🇳🇬 while my husband is a US citizen I can say for a fact it’s not easy , if possible let him visit. my husband comes to Nigeria twice a year and it’s really amazing so while we are still waiting he always visits. my advice if you can afford to visit your spouse while you wait please do🥰

@BAYANO PARKER the passport doesn’t get flagged until it goes to NVC, I literally just renewed my passport and esta and it was approved even though our i130 is pending.

The ESTA should work. My wife has also been able to come a few times already while her I-130 pending, no questions asked at entry luckily.
Its not as much as a proper visitor visa, but does help 🥺 wish you luck

@Jacob N my husband was here for his first and only time in 2022 on an esta. he stayed for 80 days went back for his 90 days were up. he got another esta months later and they denied him at the airport for suspicion of working. he wasn’t, but the officer just kept saying “not today, try at the embassy” so he is flagged because of a text that said “everything is cheaper here” to his friend talking about the food at a restaraunt. nothing about working.

@Jose Castillo lots of questions were asked when he got to the Dublin airport with his esta. he was denied that day because of a text he sent to his friend, the officer said he was suspicious he had been working when he was here for the 80 days earlier that year. the text said “everything is cheaper here” nothing about working, he was talking about the food was priced way less than in Ireland. so after that he had to apply through the embassy for a visitor visa, which he has 6 times. denied everytime. it’s crazy.
