I receive my RFE today under the docs tab. my petitioner has a low income and am making alots though that will work but they asking us for the I-864. my big problem now is my wife didn’t file her tax
I receive my RFE today under the docs tab. my petitioner has a low income and am making alots though that will work but they asking us for the I-864. my big problem now is my wife didn’t file her tax for 2021. her mom is ready to give us the joint sponsor. So my question do I still need to submit my wife previous tax return or transcript . My mom in law is making alots.

You did not submit a properly completed and signed Form I-864, Affidavit of Support, for the petitioning sponsor,l, listed on Form I-130 or Form 1-129F. Even if a joint sponsor will be used, the petitioning sponsor must submit Form 1-864 (Form 1-134 is not acceptable for Adjustment of Status). In order to process your application further, you must:
• Submit a completed and signed Form I-864, Affidavit of Support, from the petitioning sponsor. A valid signature consists of any handwritten mark or sign made by an individual, and does not include signatures created by a typewriter, word processor, stamp, auto-pen, or similar device. All pages must be present and of the latest edition date.
• Provide the petitioning sponsor's Social Security Number on Form I-864.
• Provide a complete and correctly calculated household size on Form I-864.
• Submit a complete copy of the petitioning sponsor's Federal income tax return and all supporting tax documents (W-2s, 1099s, Form 2555, and tax schedules) for the most recent tax year.

@mike Omar the recent tax year is the 2023 tax return filed this year. I got the same exact message and my lawyer helped with my joint sponsor to get all the required paperwork. I just sent it in yesterday.

@Lilian A thanks for the information, So the 2023 is fine for my spouse right. Do you have any idea of what her mom will be sending out as the sponsor?

@mike Omar,my joint sponsor was asked to send 6 months pay stub,letter from his job stating how much he earns, what his job description is and prospects for future work and salary annually. 2023 tax,1099& social security number on the 1-864 form
