is he in the states? did he file an I-485?

he has been in the states since 2016 we've been married for 3 years together 7 and we only did the i-130 and i-131

consult with a lawyer. if I’m not mistaken the I-485 and I-130 need to be filed concurrently. what is his current immigration status?

right now we're waiting for the petition to be approved and he was in removal proceedings he has a two year old daughter and see we have a lawyer but I feel like he's just sitting on his ass and see that's what I thought you were supposed to fill them both out together

see he told me that I couldn't apply for his green card or I couldn't do the i-485 , and he told me I was wrong and we've been waiting since 2020 for my petition when I first filed course we had to put in inquiries , he said we couldn't do it because of the removal proceedings but I didn't think that was right

the i485 is for Adjustment of Status, that would give him a green card. i400 is naturalization, but he probably would need a green card prior to that. I’m not a lawyer, and I could very likely be wrong, as I have no knowledge of the procedure with removal proceedings, so the best advice I can give you is to find a new lawyer asap

I'm just going to get another lawyer because I can't have my husband uproot out of his home or my daughter not have a dad just because of a lawyer wants to sit on his butt that's not fair I mean the lawyer wouldn't like it if he was just if he could be uprooted out of his life his family his home you know it's not right and thank you because I'm sure going to get to work myself just like I said if the lawyer won't do it I'll call until somebody helps me and I'll do it myself because no family member of mine is going to be taken

another advice is to spend some time reading the USCIS website, they’re not always straight forward with directions and you have to really read and interpret what they mean, but it would give enough background information to have a better meeting with a lawyer

adjustment of status yes Lara he did put in that yes they said we couldn't get the naturalization until the green card is approved but I might will when can we put the application for the green card in you know you have to put in for a green card to get the naturalization, and yes baby one that doesn't get your money and run and then sits on his you know what and does nothing that's why the lawyer talks to my husband now because you know my husband's a whole lot nicer than I am and I'm very nice and respectful but you know just like I told him what if it was your wife or your daughter's dad you know he sure wouldn't be sitting down twiddling his thumbs like he's doing and I just felt like I needed to get it off my chest almost 600 days !!

and you know I do have a learning disability Lara , but by all means that's why we hired the lawyer because I didn't know and I still don't know everything but I'm trying to learn and that's why we hired and gave him all this money and now it looks like my husband's work permits going to come before our petition and I did the petition like at least a year before

I totally get it. as the immigrant myself, I love how involved and determined you are to get this solved. it’s pretty stressful for us and for our entire families. doing it yourself is totally doable (I’ve done so many of my previous visas/aos myself) but, since there was a removel proceedings, I would highly recommend finding a lawyer that is knowledgeable on that
