how did you come to that realization?

reason I ask is because my i360 is still pending and I got my i765 approved.

Hi guys, I hope you can guide me to a brighter understanding of my situation, Back on February 2023 when my visa category (f2a)was current on both charts my lawyer filled concurrently my I-360 I-485 I-131 I-765, so around April 24 USCIS rejected my package because it was filled to the wrong office(Vermont) so we needed to re file to Nebraska(now my category was not current), anyways USCIS set my priority date as February 16. On June 1st USCIS rejected my form I-485 for insufficient funds, this time I was really mad because this was the second time my lawyer messed up, I ask her what happened, she said that this was a USCIS mistake, I believed her and we submit again the package with the corresponding filling fees and a letter explaining USCIS that at funds were available at all times and they should honored my priority date, I am not sure if they did it or not, since in any of my notifications I can see my priority date. Several months passed, on November 11 my lawyer notified me that I had biometrics appointment on November 22nd for my I-485(code 3), I went to the ASC, everything went smooth and with no issues, couple days after the system updated to Fingerprints were applied to my I-131 and I-485; form I-360 and I-765 did not show any updates, it started to seem weird since we filled them concurrently and were supposed to be updated together (for what I knew at that time), so I asked my lawyer, she just said that it was matter of time until they update them, so I waited patiently until March 28th when I finally decide to attend to her office to collect all my notifications and found out that she did not notified me about other biometric appointment on November 30th. I feel really disappointed about her and hopeless, I already wrote a letter to the Vawa office explaining my situation, and the only concern I have is, Will they use my I-485 fingerprints for my form I-360, or will they just close my case? as today they did not close it yet. and finally Will they still adjudicate my I-131 and I-485? Or Will they just wait until my Vawa approval to finally adjudicate them? Thanks, #vawa #I-485 #I-131 #I-765 #adjusmentofstatus

@luck better if you i360 is not approved I would say is c09 EAD, but it depends as well. if your EAD is c31 it mean your vawa is approved ? what status on your I360

@luck better If your ead is c31. You will not be able to receive your Ead card until your vawa is approved. Refer to C09.

change lawyer. if he don’t know how to file I765, I am curious how he files your VAWA….

@GODANDTIME spice i did submit FOIA and got response and in my application i see attorney submitted it as c31

@imo imo i am preparing to send it with a letter saying to update category. i will send it to nebraska lincoln usps po box. Thank you for suggestion

@luck better I know someone with a similar situation she was advised to just file a new I-765 and base it on the I-485 C09 , instead of VAWA because that was going to be faster than trying to get them to update. You might want to look into that too.

oh Dios yo tengo el mismo problema hay algo que se pueda hacer en este caso para que actualicen la categoría Oh God, I have the same problem. Is there something that can be done in this case to update the category?

@Ko ka what is refer to as C09 ? my renewal c09 is approved 2 weeks now and I haven’t got my card yet . it’s been 16 days and my i360 is still pending it’s already 36 months . what does that mean ?

@luck better hey that happened to me as well…. I had my lawyer refile i765 and i131 under c09 category and got approved. Please do or else you’ll be waiting forever

@champs d can you pls share your 360, 485, 765 initial and refile and approval approx dates. It may help me to understand timeline. pls share ur lawyer info as well. Sorry if i am asking too much. looking for some help

@luck better my lawyer did the same with me. after waiting for 12 months he then advised me to re apply for C09 category. I applied again in Jan 2024 and now again waiting game started. Till now I don’t have my EAD. I questioned my lawyer on this but they are trying to convince me that even though they filed for C31 many of them they received EAD card on C09 basis. they aren’t ready to accept their mistake. And am facing problems due to their mistake. Am so frustrated.

la espera desespera@la espera desespera me pasó eso a mi por contratar una abogada sin experiencia en casos Vawa! Lo que tuve que hacer fue contratar otra abogada que lleve mi caso y tuve que volver a someter la I765 C09 junto con la I 131 ( que la anterior abogada no me quiso someter) empeze el caso (completo) en Abril 2022 en Septiembre del 2023 sometió los permisos y fueron aprobados el 15 de Marzo! Vawa sigue pendiente!
