I-765
I have an EAD from my OPT after I graduated college. I’m currently on J1 visa and applying for a marriage greencard. my husband is a US citizen. Do I have to submit I-765 form? if yes, do I choose the reason to apply is “renewal” or “initial permission to accept employment” in part 1 of the form?

ilyes you need to reapply as the opt is only for one year and I assume it expires. I think it would be intial permission as it is under a different category. you would check yes I have applied and got a card before. you would use the same ssn that you got before and put that in the form so ypu don’t need a new one until you get the greem card.

only way it can be a “renewal” is if it falls under the same category. Look on your current EAD for the category and then look at the one you would when you husband petitions for you.

You need to apply for new EAD with I-485. If you are eligible for STEM OPT then you can renew your current OPT EAD. Also make sure you don’t have 2 year residency requirement with your J1 before applying for I-485
