i-751 Removal of Condition
Greetings community. so basically I have been married for 18 months. I got my temporary green card in month 12.. but we end up agreeing to get a divorce due that she wants to live outside of the States and doesn't want to have kids. we did counseling and it did not work. Basically now we must wait 12 months to get a divorce and obtain the final divorce decree. Should we still have our names in the lease, car insurances, mutual accounts, renters insurance, and so on so for... Until the divorce is finalized or we should just take out our name from each document and file? Before finalizing the divorce. How would I be able to remove the conditions, at what time, and until what day should I have my proofs of bonafide... I am soo confused and if we started the process of divorce do I must be in the same state even do that she moved to Europe?. Also if we remove our names from our cars, and all the documents that bind us would that affect our immigration case for the future, or which one would be the ideal case? please if somebody could explain me in detail and more I would really appreciate everything. if you can wait until you apply for the 10 years green card that would be great. you file for the green card 3 months before the end of the temporary green card (the two years green card) getting divorce before you apply for the the 10 years one, could cause problems in the green card.

You should be able to have as many documentation together till your divorce gets finalized because that’s what they are going to rely on when you file for i751 along with a waiver. So don’t worry about removing the names just yet from joint documentation as they will serve as proof of joint coinhabitation till your divorce. See if it’s possible to file for joint taxes for 2021 if your divorce is not finalized till then so that u can use that as evidence as well in future.

and what about the lease? because to be able to get divorced we must have 12 months of separated addresses. any feedback on that?

Well I understand that my friend. U can just go to the state of Nevada where residency requirement is only 6 weeks before you can file for divorce in that state rather than having to wait for 12 months for separation if you want it that quick. But it’s crucial you accrue enough documentation for waiver of i751. Also make sure if the divorce is happening, take affidavits from mutual friends or family members saying that the marriage was genuine. Everything counts
