I-751 N-400
just got approved yesterday for me VAWA I-751 after 2 years, I decided to just do my citizenship since I'm qualified and that would force them to address my I-751 quickly. the officer told me she was gonna denied my N-400. I didn't want to ask much question how ever I told her I still wanted to do the test and I did it, she said I'll get a notice with denial. before the day end she called me telling me she's going to approve me N-400, I was soo happy guys. I did my VAWA-I751 I-751 and N-400 all by my self.

yes I applied for the N-400 in February and got a interview date for May 24th with a interview, was hoping that would waive my I751 but they'd didn't, they gave me a combo interview

if you get approved through vawa you're qualified after 3 years under INA section 319a if still married same 3 year under INA section 319b other wise 5 years if divorce minus the 90 days

I-751 was approve base on the evidence gathered through VAWA so yes it was approved along with my N-400

VAWA come in when you are getting abuse in your marriage, physically, mentally, emotionally any one of the allies.

ohk so i got my 2 year Green card in May 2019, October of that same year me and my wife got seperated, april 2020 I put in to remove condition way before the time because i knew vawa process is a bit lengthy. my wifed filed for divorce and it approved in July 2020 fast forward 2021 i did bio metrics and waiting for a interview how long, 2022 I'm eligible for citizenship once my I751 is approved based on the vawa act, I sent off my citizenship so that would forced them to make a decision on my I-751/VAWA I got my citizenship 2 months and two weeks after sending my N-400 off

if your case is/was approved you're eligible for citizenship 3 years of having a GC just put for PT1. information about your eligibility tick (E) (have been an lpr for 3 years VAWA, INA ss 319(A))

@tevin roberts. this is confusing because you can’t file for vawa with i751 only 2 years greencard but with i751 you can file a self petition you’re not filing i360 with the i751 you’re only going to file based on the waiver either extreme cruelty or divorce. whichever way congratulations.

@nickiesha thanks, yes it's basically a waiver to file separately, once you attained your conditional GC through marriage and you've been battered, yes this is what you would do to remove condition. Google helps alot....... the immigration told me I wasn't qualified for Naturalization, but call me a hour later to told me she was gonna approve my case

you can’t file i75 with vawa. you already have 2 years green card already, it just for your file for condition removal. you case is different from people who doesn’t have green card that file for vawa

i woildnt say it'smarriage base, my 2 year Green card was marriage base. my 10 year was approved through vawa, vawa applicant get the same benefits as if you were still married and living together

oh okay! What if you already filed n400 and got interview date before your spouse filed for divorce and you are still married but have to go for for combo interview with the waiver since you are now separated. Will they make you file a new n-400 or will they just wait until your I-751 waiver is approved and then approve your marriage based n400?

they’ll do both interview same day, they have to make a decision on your I751 to get to your N-400

oh okay. Thank you. My interview is in a few days. Any idea what will happen or be the next step when I get there and tell them my I751 I filled with my spouse will need to be updated to a waiver since my spouse just filed for divorce some weeks ago?

P B, if your wife filed for a divorce weeks ago they might not grant you the n400 and do the i751 interview and give you sometime to bring your final divorce deceee. if you’re divorced and not extremely cruelty waiver ground and your marriage is in the 3 year rule for filing n400 they would not go through with your n400 except if it’s 5 year rule. I think Tevin robert i751 was waived on extreme cruelty that’s why he was able to do the n400 interview. I have the same issue and my lawyer adviced I go with extreme cruelty waiver ground since my spouse isn’t disturbing me for divorce yet. Some week back he asked for my address that he wants to send divorce petition I told my lawyer and she said just ignore him for some time that she won’t advice I do the divorce waiver as well cuz my n400 fee and everything would be a waste since I’m filing with 3 year rule. Just go to the interview and let them know your wife filed for divorce few weeks back. I’m sure you’d do the i751 and they’d ask for RFE regarding the final divorce decree

Tevin, Please help me with the process. Condition Greencard Mar 2019 Separated, Nov 2019 Laywer Applied for I751 waiver due to battered spouse, I360 & I485 in Sept 2020. Still waiting on all of them. What would be the next step? Do I need to get all of the above approved or Is it two separate process? When can I apply for n400, In us from mar 2019 with Condition green card expired on march 2021 and currently on 18 month extension

Sam P, why would your lawyer file i485 when you already have conditional greencard in 2019. You should focus on the i751.

Sam P you can apply for your N-400 anyt time now, and it's gonna force them to make a decision. did you mean I751 instead of I485? because u said u already a conditional resident

yeah! you shouldn't need to file an I485 to remove condition, that is to adjust status which u already did.....if that's what your lawyer did she's leading you the wrong way

Hello Tevin I got a question that I would like to ask you . Is as you mentioned you and your wife were separated and divorced. So filling separately , didn’t affect your N400 ? Since tax returns is a must and officer always want to see them as proof?
