I-485 RFE for birth certificate
Hello, when I submitted my AOS i included a copy of my statutory declaration of age in lieu of my birth certificate since I don’t have one and I just received RFE to provide a copy of my birth certificate for my I-485. I’m really surprised and confused because I expected my age declaration to suffice. I don’t know what to do at this point because I don’t have any other document to proof my age, apart from my statutory age declaration. I will appreciate if someone can advice on what to do next.

is the declaration submitted from an authorized government body or population agency from your country? what country are you from? does that document state the names of both of your parents?

If you do not have the original birth certificate, you can include a copy of a testimonial from the first school you attended; the record should include your details (name, date of birth, age as at the time of enrollment, parents details etc); you can also back that up with sworn affidavits from two people who had direct knowledge of your birth; these people do not have to be US citizens; those documents are considered secondary proof of birth. you should also be able to get a certificate of birth from your home country, and back the certificate up with those documents I mentioned above. you can find other documents that’ll suffice to support proof of birth on the USCIS website. good luck. :)

@Ekun o I’m from Nigeria and the document is from the high court of Lagos state and the document states my name, my parents’ names, dob, place of birth etc

@Dani Ade, Apart from my age declaration. I don’t have any other document as proof of age that has my parents’ names on it.

someone can go to the national population commission on your behalf and get you a birth certificate, that’s what I did.

yea you can go to the Npc like everyone has said, get the birth certificate that has ‘presidency’ on it. but mind you, if the year of registration of birth on the document is more than 4 years after your birth, it may get rejected again. so you can support it with affidavit from two close relatives and the primary school records; your primary school records should have your parents details; including your details. that is what I did, and no RFE yet; my lawyer actually advised me and I guess it worked

@Rid i I am from India and I do not have a birth certificate, I provided a copy of Non Availability certificate issued from the Municipal corporation where I was born and copy of 2 sworn affidavits from my mother and brother or it could be from a relative if you don't have any siblings. I provided these documents along with the original documents. I got an RFE for my Birth certificate and forwarded the same documents again. I have an attorney who is helped me file the original forms and also the reply to the RFE for the birth certificate. I was surprised why they sent me an RFE though we had submitted these documents alongwith the submission of the forms.

@NYC It is in status Fingerprint applied to your case since March 2021 when I gave my Biometric . Still waiting .Mine is AOS IR5 Category Field Office Mount Laurel NJ . Applied on Nov 2020

@Rid Uscis recognize the birth declaration from the Nigerian population commission not high court. you can get that. I used that too

I tried talking to someone to help me get it at national population commission office in surulere but what they say I will get is ATTESTION OF BIRTH LETTER, is it the same as ATTESTION OF BIRTH CERTIFICATE and will uscis accept it? any info will be appreciated.

well for me I got my original certificate of birth (which is not the same as attestation of birth) from National population commission office in my state.; and I am above 18 years old. see what ild advise you to do, go to your local government area, get a birth certificate from there, then take that birth certificate from your local government to the NPC, they will use it to get you another certificate of birth which to USCIS is more authentic. There is usually a folio number on the certificate from your local government certificate, that is the one the NPC will use to issue u another one. But if your birth is not registered at all, I think the attestation of birth should suffice.

hey @AI_ L. Can you or anyone else give me a plug to get my NPC birth certificate? I have one from my local government as I was born in 1991 but I will need the NPC one

not sure u need a ‘plug’, take the one from your local government to the Npc office in your state. they will use it to issue you the birth certificate. the only plug u need is money. nothing is free. I think 15-20k should do it. and any family member or friend can make the move for you.

lol… no oluwole version. Let him go to the Npc office in his state and get it done; it’s a public office.; I mentioned the money aspect coz that’s what you’ld need to fast track the process. asking him to use a plug is the main reason he will end up with oluwole version like you just mentioned.

@jemi yes they need the original copy. or you may want to ask if they will agree to use a photocopy. Notice there is a folio number on the Cert from your local government. That folio number points to a document, and that document is the other registration of live birth (same as cert of birth) NPC will issue you. I was born around the same time as you; and I’m telling you exactly what I did. I did not even know about all that, until my attorney adviced me and I had my dad go to the NPC office to make inquiries.

dani ade, were you born after 1992? if yes then you can get birth certificate, people born before 1992 will only get attestation if birth

@jemil A, if you were born before 1992 then you’ll get attestation of birth but if you werw born after 1992 you can get your birth certificate from npc

@patsree , I've had the same situation here , I didn't receive any RFE yet but I've submitted the Non availability certificate and 3 sworn in affidavit which I took 4 years back, I wonder will there be any expiration date for affidavits we provide ? also what's your birth certificate RFE status?did you hear anything on that ! tq

@de thanks for an update.. could you explain it ok attestation ? coz I've submitted non available certificate attested and 3 affidavits from my mom, dad and my aunt in back 2017 and submitted with my AOS last year ... does this means I have to rework on the affidavits ?

hey guys, I am in same boat. Got rfe for birth certificate even though I submitted affidavits and govt id and school records. My original birth certificate doesn’t have my name on it. Did your rfes get cleared? I woudl like to know what did you finally submit?

@gb pwl The country you are from will determine the type of document that’s accepted in lieu of your birth certificate. In my case my home country is Nigeria so I got someone helped me get Attestation of Birth letter from the Nigerian government agency responsible for issuing such(NPC)

Will an Attestation of Birth Letter from NPC (Nigerian Population Commission) suffice ? I was also issued an RFE for a copy of my original birth certificate but I was only able to get the attestation letter. Do I need to submit supporting documents such as school records, affidavits, e.t.c along with the attestation letter ? Thanks
