can your spouse file your I-485 (adjustment of status) while he’s a green holder and you in the US unlawfully?

How many more years does the green card holder have to become a citizen? If it’s like two years or less. Atleast before you guys would be called green card interview it takes 2yrs atleast.
My Hubby’s then lawyer made us file only i130 when my hubby was a green card holder. Exactly two years after he got his citizenship and we filed the remaining forms. I was on a student visa up until after filing the rest of the forms.
Now the thing about green holder spouse is that the spouse is scheduled interview in the home country or any other country of choice but not the USA.
Our lawyer explained this to us. Form i130 has a place in the form that requires country of interview . Our lawyer had to put Canada since I had a valid Canadian visa and didn’t want to go to my home country.
If one overstays and files all forms while married to a green card holder. The problem is when an interview is scheduled in their home country. If the person goes ahead to live the US who knows what will be stamped on their passports.
I think you can just file i130 then whenever the citizenship comes file the rest of the forms. Before filing the rest of the forms , Call USCIS to update information about your citizenship.
My i130 was finally approved after my hubby called to mention he’s now a citizen. We got RFE but it was approved quickly after that.
