I-485 Public charge question answer
Hello all. Has anyone received any RFE or anything for selecting ‘No’ to the I-485 public charge question? Any response will be highly appreciated. Thank you.

I got an RFE for it - the RFE specifically mentioned that I was subject to the public charge policy as I was applying as a multinational manager (eb1-c). My lawyers (very reputable firm) mentioned it’s the first time they’ve gotten an RFE for answering No. All we had to do was to respond with a new I-485 with the correct answers. approved the day after mailing in the response.

@PK Das Almost everyone (except for very few) are supposed to answer yes to the public charge question, so if you answer no, you will get an rfe and all you have to do is refill the doc and answer yes.

@PK Das why would someone say “yes” to public charge rule when you don’t apply for government benefits. please, can explain it better? Thanks

@PK Das — whole doc - the field office also requested that I put my initials and date next to each question in the public charge section.

@PK Das you will be fine as long as you refill it and answer Yes. USCIS knows that question is pretty confusing. There were quite a number of people that answered no

@ChristinMe 003 thank you. I hope so and yes, the question was confusing indeed. I submitted I-485 on December 28,2022, and still waiting on USCIS. Hopefully, they will send something soon.

My lawyer is from Ellis porter and they told me to say ‘yes’ because the public charge rule applies to me ( as well as most of us) except certain class like ‘asylum’. saying ‘yes’ doesn’t mean you have done the things mentioned in public charges ( like, long term hospitalization, or taking cash benefits) rather it means that the rules of inadmisibility ( public charge rules) applies to you. so I think you have to say ‘yes’.
