I-485 pending , marry and add spouse
I am currently residing outside of usa . I intend to marry a U.S.-based EB-3 applicant who is an RN nurse. She filed her I-485 on April 26, 2023, when the Date for Filing was current. Her I-140 has been approved, i-485 pending and she is currently in the U.S. on EAD/AP while waiting for her priority date (now retrogressed to April 3, 2023 under Final Action Date) to become current. We are planning to marry in Nepal soon, before her green card is approved. After marriage, she plans to return to the U.S. and update her I-485 to include me as a derivative spouse. What is the correct process for her to add me, and what forms or steps are required to ensure I can obtain an immigrant visa through her EB-3 petition once her priority date is current,lso how much time it stake for i-485 to get approved after the date being current, and what are the steps for both the person?"

hello @Guru Baa your best bet will be to use a lawyer and probably use premium processing . I am a derivative applicant to an RN spouse and we did applied in Jan 2023 (it’s now that our application is actively being reviewed we received RFE for medical last month) but we had done our wedding a month before filing.

I think you just need to send your 485 and attach all necessary documents to proof marriage. make sure that her petition has not been approved else you will need to go through the i130 route!

@Pinto M What is your Priority Date ? mine is January 30,2023 and do not have any update on my Case yet. Regarding RFE for medical, did you submit your medical when you Filed in Jan 2023? I submitted mine when I applied on March 2023 and it has been more than 2 years. I wonder if I will get RFE for medical.

Jan 23rd is our PD…yes we did but any medical that was submitted before November 2023 is expired apparently…so be sure you might get an RFE

there is also an option called: following-to-join I-824 if your marriage happened before green card approval. check with lawyers to see which one is best for your case
