I-485 Outside the US
Hi! I recently found this community and love it so I wanted to start by thanking all of you for sharing your story. I am under the understanding you cannot file am I-485 if you live abroad. we filed an I-130 for my husband and it’s currently being processed. After the I-130 gets approved what comes next? can he come to the US? I was told he needs to file an I-485 but I don’t understand how he could do that living abroad. I will be so heartbroken if we have to wait for an I-485 and still not being able to be together.

you can only file i485 if your currently in the US..after the i130 gets approved you would need to do consular processing.

The I-130 is the only form you need to file with USCIS. After your case is approved by USCIS then it will be forwarded to the NVC. With the NVC you will have to complete 2 forms. 1. I-864 and 260. The NVC will set up your consulate interview. after the interview and the visa is granted, you will be given a very large envelop to be handed to the airport homeland security team before entering the USA. You will have to pay a few for the green card before your spouse leave their home country. Once that fee is paid, you will have to travel within 6 months to the United states. When you arrive it will take 2 weeks to 1 month to get the green card and social security card in the mail.
