I-485 outside of normal processing times ombudsman
hello,
I applied for an EB2 visa in Texas on December 2017, my I-140 was approved and I had my AOS interview in December 2020. it has been 13 months and no response.
Things I did so far:
opened 3 outside of normal processing times.
on the first, they said my application needed further processing.
on the second, they said it was pending background check.
on the third, (they responded this week) pending background check again.
I reached out to the Congresswoman:
they called me from congress on the very next day, on the phone they told me they were willing to help me expedite my I-765, but they could do nothing in regards to my I-485 because the processing times don't apply to cases that have had the interview. ( the expedite for the EAD was denied by the way).
I reached out to ombudsman, they sent an enquiry to USCIS about two months ago or maybe even a bit more. then they got no response from USCIS, so they send me an email about a month after telling they were sending a follow up enquiry.
today the ombudsman sent me an email with the following information:
Thank you for your request for case assistance. In response to our inquiry, U.S. Citizenship and Immigration Services (USCIS) indicated that your case is under active review. However, USCIS was unable to provide a specific timeframe for resolution of the case. Our office will continue to monitor USCIS’ progress on a regular basis until there is a specific action or resolution. We will notify you when we receive an update from USCIS.
So the response from the outside of normal processing times two days ago said it was on background check and ombudsman just said it is under active review.
maybe background check is also active review?
has anyone experienced these messages?
any tips on what to do?

my case been in background check for the last 6 months still nothing.. it may be realted due to country of origin

and I didn’t know that processing times don’t apply for cases that had an interview already under employment based category.. that’s not nice 😟

no, I had 3 AEDs already, but they all expired after a year. I am renewing the EAD. about the processing times, this is what the Congress told me, but USCIS does let me open outside of normal processing times requests.

ok i hope you get it soon .. background checks is the basic response I believe they have for pending cases .. I had asked for a friend in this forum here who had interview about 5 6 months back and tier 2 officer said background checks ..

yeah, kinda hard to know what is true. there is a chance they say that just because you cannot keep asking much since it is not them who perform the background check.
I wish I new how to contact the FBI to ask if it is pending background check.

I do not know what is happening in TSC. I have been waiting since April 2019.
