I 485 is still pending
Hello everyone. me and my husband attended marraige based interview for his adjustment of status on October 6 , 2021 at the NYC federal plaza office. still no word from them. the IO said he would recommend us for approval but didnt get green card for my husband till this day. we filed October 5, 2021 . anyone in a similar situation, his work permit has expired its so fustrating.

delays are quite normal and of course USCIS has technically 120 days to decide a case.
my interview was on Oct 14, 2021 and my case was approved on February 1, 2022. they are things I can suggest, you can do an inquiry by calling uscis customer service (say infopass, and I’ll connect you with a live agent), if you get closer to the 120 days mark you can contact your congressperson for an inquiry also.
meanwhile you could renew your spouse work permit. which you should have done it, just in case.

@israel that not normal, I would not let that happen. by law USCIS (federal agency) is required to process an application in “reasonable” timeframe. 1yr only occurs either if an investigation is happening or they just left your file in an empty desk. I would take some of the steps I mentioned and even my attorney would write a letter to the field office director if I happened to be in a situation like that.

@falco yes I first did an I inquiry on my own and then I contacted my congressman, USCIS replied that they admit my application is getting almost outside normal processing time, and that they are still processing it. after almost 2 weeks my case was approved.

@Richard outside normal procession time as per their timelines on the website or 120 days mark
if I follow the processing times for our field office it is way longer but I am reaching 120 days with no decision soon
we were given a paper saying we will hear back in 120 days
we are going to send a copy of same to congressman office in the email

I have the similar case, my husbands ead is expiring in 15 days and he is loosing his job.
- We have filled I765 on june 01 2021 still pending
- I485 filled ead renewal in feb 2020 still pending.
- Talked to congresswomen office and sent a privacy release form and they said uscis will get in touch with us but now one reached out
