i-485 denied
We got an RFE related to I-693 and I-865 in April 2023 and we responded with Civil Surgeon reports and other supporting documents.
So both of us received EAD cards and I -131 travel documents (combo card) a couple of months ago and my Wife left the States in July, 2023.
As of this week, my wife received an I-485 denial notice (August 21st) citing the reason that the RFE was not responded on-time.
However, we sent the response to RFE via FedEx on April 15th and the FedEx document was received and signed by a person called J.SMALLEY in Lee's Summit office. We also have the proof of FedEx tracking number information and receiver's copy from FedEx.
"Ask Emma" live agent in USCIS website recommends we open a I-290B and request to reopen the case.

I think you can appeal it
but filing new one is faster

Appeal your case through a lawyer. It works even faster than reapplying if done correctly.

@Sim Tabby What timeline are you thinking? attorneys sent 290B 3 weeks ago as expedited, ended up in Vermont, no update in 3 weeks.

@Jan B My attorney submitted the I-290B in May and they responded in early July. Be patient, they will respond especially when they are in the wrong.

@Sim Tabby when your attorney filed 290b , did your attorney choose Motion to reconsider or Motion to reopen . Did the attorney resend all the RFE documents along with the proof of mail/courier tracking information OR just the courier tracking information to prove you responded to RFE on time ? Thanks in advance .

@Gopal Kondakindi Motion to reopen and l am uncertain of the documents he sent with the appeal. A USCIS agent even called to apologize.

@Jan B I sent my I-290 b at Vermont too as expedited, it was received on June 27th, 23. no update since. I have left country since 2 months now. please share email, we can keep up there to discuss our case timeline.
