I-485 Denial after Interview
Hi Everyone, I am in a very critical situation. I received a letter from Uscis regarding denial of my I-485. The reason stated being my non immigratant visa was revoked on July 8, 2020( my Priority date). Also accused of fraud or willfully misrepresenting a material fact. My question is how can this be possible ? I was issued EAD and AP after filing my i485 and I’ve been working for almost a year for my sponsor. I had my interview completed in April 2023 and the status was stuck on -Interview was scheduled ever since. Can someone please advise me on this ? Anyone who has experienced such a scenario? pls pls share your thoughts.

@sg 55 it says your non immigrant visa was revoked. have you come under f1? ap and ead are not related to your previous visa. they denied because they found something before your I-140.

@N F yes I came on F1 find what about before i140 ? I’ve always maintained my status and stayed here legally. any idea what can it be ?

@sg 55 It says nonimmigrant visa. probably it's related to F1. it seems your university annulled your I-20? have you violated anything there? stopped going for classes when enrolled? or have you changed to b2? read your RFE properly. they usually give full information what has happened with the dates. if you believe uscis made a mistake you can appeal.

@sg 55 After you file your L.C... Did you maintain your F1 status till you dont receive your i485 receipt??

You have limits time to submit I-485 again, read carefully from the letter that USCIS give it to you and go talk to attorney. Attorney will give you advice how to solve the problem

@Barb B I was asked if my visa was revoked previously which I responded yes because after i140 approval I quit school. can that be a reason ?

Didn't they give you more information about that? Does the letter just mention fraud? Would you be able to share the letter with me, but hide your personal information?

i think, check yes/no questions in the i485 file and remember your answer. your f1 visa is not revoke because of approved i140. revoke means you violation on your f1 and when you said "yes" like you mistakely commit that you have not maintained f1 status so I think thats the problem. try to check the form 485 you submitted and also remember your answer correctly so attorney can help you dispute your case

@sg 55 you should not have quit school. you should kept the F 1 status till the adjustment is over

you can quit school as long your I-140 is approved and I-485 has been pending

@sg 55 i saw on your timeline you got an interview and then Uscis send RFE for you. what kind of evidence they asked you? and what is your case status after interview and summit evidence. is it case remains pending?

@sg 55 Looks like you didn’t maintain your status up on the filling of your i485. Even if you went out of your status upon filling the adjustment, if you are 180 days grace period by falling status , you should be fine but if not you should contact attorney asap.
