@Mrkvica M. My attorney just told me he got a NOID. From what they wrote their, it’s similar to the NOID I got couple of years ago before I filed vawa. When I was still with my ex, I got NOID on I-130/485 which I responded to but they denied both and after few months, they reopened the I-130. I guess the officer didn’t go through my response before denying it hence the reason they reopened it. Since then, the I-130 remained opened but since we were having issues, I moved out and filed vawa. I will see my attorney tomorrow, I’m just tired at this point. My attorney said in his over 3 decades of practice he has not seen things like this

@F A okay, but what was the reason for deny?

@F A could it be that they made a mistake and they send noid for the previous marriage based I-485 again? I am so heartbroken for you but this is mistake. Just see your lawyer and see what you can do

@Mrkvica M. don’t know if it was a mistake. Will see him tomorrow and know what to respond with. No, I didn’t get an update on the app. I’m using my attorney address, so all my mails goes to his office

@Mrkvica M. I don’t think it’s a mistake. if they asked for clarification first time few years ago, and issued NOID, and then denied for some reason, probably this reason still exists and they found it. USCIS always check all previous applications and compare everything.

@F A but usually they update your status on your app. Maybe this NOID was the same noid from years ago

@F A than can be a big issue, because if they think your marriage was not bona fide, your approved VAWA may be revoked. Bona fide marriage is one of the requirements for VAWA

@survivor p that's why it doesn't make sense. Why would they approve VAWA? 🤷‍♀️

@Mrkvica M. because VAWA is adjudicated based of documents you sent to them. they don’t check any previous applications or so. But they do this when adjudicate I485. unfortunately I know many cases when VAWA was revoked because I485 adjudicator found something in file

@survivor p oh, I thought they check everything before making a decision about VAWA. But @F A lawyer sent an explanation for the first NOID so maybe USCIS never received explanation

@survivor p I responded to the NOID with enough evidence. They asked some questions during our interview that they claim we gave different answers. here is one of the scenarios, they asked what update is being done to our apartment. I said general update because a new company is taking over, my ex mentioned they are updating, kitchen, bathroom etc…..my attorney responded that it’s still the same just that I didn’t expantiate like my ex, another question they asked was the name of our property management, I mentioned the old management cos that’s what’s on our lease, my ex mentioned the new management that just took over. as a matter of fact I didn’t know they’ve finalized the change at the time of our interview so while responding, we got an email doc from our new management stating when they took over the apartment with a copy of our old lease showing the management I mentioned and our attorney responded to that…..those were the scenario mentioned. it was during Covid we responded and they denied few weeks after mailing our response. I just want to believe the officer didn’t go through our response before denying both 485 and 130. The 130 was later reopened but we were having issues so I moved out

@F A ok, just breathe now and go to your lawyer tomorrow and see what your lawyer recommends. I know you are tired and it's tough but you are so close

@survivor p we have health insurance, car insurance, 4yrs tax return, 2 separate joint accounts, rental lease, gas bill. I also have note from therapist I saw during the marriage, a note from my ex son saying he knows about the relationship and that we lived together, different pictures even with my family . How else I’m I suppose to show proof of bonafide marriage?

@F A , with all the evidences that you mentioned above, you have enough evidences. However, the transfer of your I485 from Vermont to FO might not be accompanied with those evidences, hence, provide them with the evidences you stated above and get some letters from those that you about your marriage. I believe you will be good

@AUG 22 Thanks, I have a folder I keep most of the document I send to uscis, I have brought out the folder this evening to start putting the document together. I pray God sees me through this, amen

I’m sorry to hear this, did you file a different/new i485 for vawa , if yes check the i485 receipt number to be sure it’s the right one associated with the VAWA 2. if no, is the reopened i130 still open till now? it’s possible that because it’s still open and pending a decision , the officer may be looking at the i130 rather than i360. It would have been better to have withdrawn the i130 when you switched to VAWA. you can ask your lawyer his/her opinion about withdrawing the i130 now, and the possibility of filing a fresh i485 specifically based on vawa. I.e if that hasn’t been done. just an idea. May God give you the strength&peace to see this journey through.

@F A probably your Ex Wife reopen your previous i485 and claim that you were cheating or bulshit like this

@F A, seeing this broke my heart, I remembered will both received rfe for i864w same day, My hope was high for you that your i485 will soon be approve like mine and seeing this scared me. Abeg just breath in and out, release it to God to finish the good work HE has started, take all necessary document to your lawyer and sit with your lawyer to review the documents. Another way, your lawyer should write to back-up anything he/she will be sending to USCIS. A quick one, am suspecting something is going on with vawa application at the rate people are being denied at any slight mistake. Do they think people are lying or using VAWA as way to be documented. Pls God pass through USCIS for the sake of VAWA applicants.

Thank God I was invited for interview cos my ex wrote in his withdrawal testimony that we do not live together and the officer asked to confirm and even gave me opportunity to see the written testimony by my ex with the address he claimed he was living but I insisted will live together, next day I received rfe to proof that will live together despite the fact have sent everything with my vawa application. in response to the rfe, we sent Lease agreement, bank statement, two affidavit and the affidavit detail how our apartment look like and my lawyer include a written back up letter cos I remembered my lawyer asking the officer for the address my ex claimed he was living then

@PP I, your suggestion are right. Withdrawing I-130 could have savage this issue. I have a friend like that immediately her marriage case was denied she withdraw all her marriage case and start a new application and she was approved with 2yrs greencard

Hi FA, the immigration won’t approve your VAWA if they can’t verify your marriage is bonafide and there was an abuse so Survivor P is horribly wrong. there is a reason why VAWA goes to Vermont because the team there is trained to handle special marriage cases. I485 is adjudication for change of status to permanent residence and you are qualified based on your approved VAWA, few reasons they can deny your I485 based on approved VAWA are 1) you commit a crime 2) misrepresentation. i was in a group where someone had an interview and they brought his previous marriage interview issues, he went without a lawyer because his lawyer lives in another state. they sent a NOID about his marriage bonafide, his lawyer responded with the VAWA approval. apparently the officer made a mistake, his interview was rescheduled and he went in for i485 interview and it was a yes and no questions

@AU 👍🏻 thank you for explaining so what is like misrepresentation? and this friend went I 485 second time? and that time they did not ask no questions about previous marriage interview?just asked her yes no you mean for approved vawa if you go interview they can only ask about yes no questions that’s it nothing related previous interview or vawa thank you

@tired from waitingg most questions are related to the I485 form you submitted. if you have an arrest, they will ask you about that. marriage questions are for I130. if your I130 or VAWA is already approved, it means you have passed marriage bonafide verification stage except they have new evidence of fraud I485 questions are always about background check and eligibility questions, which is the yes and no questions. when you file a new case, they just include your new filing to your old file hence the immigration officer can mix up things and start asking you questions on the old file which is mostlikely what happened in FA case. but he shouldn’t worry, his marriage has already been vetted and VAWA approved, immigration can’t waste resources again to verify after VAWA approval except they found new fraud. Misrepresentation is when you lie on your form or in the interview. example, they ask you if you have worked illegally in the USA and you say No but you have indeed worked illegally.

@F A i just received update that fingerprints were taken. I had that update in 2019 (2 times) and this morning again. They are doing something

The previous I-130 is still reopened but 485 denied. I filed a new 485 with 360. I don’t think my ex withdrew the application.

@vee k amen. thank you @Temi Shalom no they did not invite me for an interview. Were you aware your ex withdrew the application? Because I still checked my i130 and it’s saying reopened. From my previous 130/485 NOID, they said we didn’t present enough evidence(we only submitted 1yr tax return, pictures, bank statement, ex divorce statement) and the reason is because we were newly married and didn’t have much things together. But by the time I filed vawa, I submitted 4 yrs joint tax return, gas bill, car insurance, health insurance, 2 different bank statements, lease agreement, different pictures, psychotherapy note I went to see when we were having issues and I thought we could work things out,). What I’m not sure of is if this officer didn’t see all thieve documents. Because after all theses, I don’t know what else to submit

For those saying I should have withdrawn the reopened I-130, do I have the right to withdraw it since it was my ex that filed it?

@FA you can’t withdraw I130, your wife is responsible for that application, I485 is your application. the other guy with similar experience as you, sent in all documents including VAWA approval document with a cover letter from his lawyer. you will definitely be fine.

@F A, I get to know I was denied via call to USCIS and I wasn’t given reason for denial cos I do not received denial letter. I have to file for FOIA which says my ex withdrew my case. Get to know of my ex withdrawal of my case via FOIA request

@F A, I don’t think it matter anymore at this stage but his written cover letter defending your case and talking about the I-130 which is irrelevant to your vawa case will do the magic and God backing. It will end in praise. I don’t know what my lawyer wrote to defend the lies my ex wrote and we got to know of the lies he wrote during my vawa interview which really helped

I just saw my lawyer, so uscis concluded that my marriage was for immigration purpose and when I completed my new 485 application, one of the questions ask if one has misrepresented or submitted false document to which I said No. So now my lawyer said we will respond by saying the marriage wasn’t entered solely for immigration purpose.

@F A how could they approve your vawa then? one of the requirements is to be in bona fida marriage 🤷‍♀️

@F A, I think adding testimony (affidavit) from 2-3 people that can give detail about good faith of your marriage will really help too. I add affidavit written by my sister who reside in our country and a friend here. It will eventually end in praise cos you will come back with testimony

@Temi Shalom do you mean new affidavit? I got 3 affidavits on my previous application, 1 from his son and 2 from my family members. I still have the copies of those. Do you mean I should get new affidavit now. we’ve not been together for 4 yrs now

@F A, Ask your lawyer if you can still use same affidavit, if yes, then include it but if no just plead with same people to rewrite another one for you. My thought affidavit from family and friends help too. NB: this is time to pray seriously for mercy to prevail just like my lawyer told me after my interview she said and I quote “We have done our part, go home and pray for mercy to prevai” The good part is I remember my interviewer name, we turn his name to prayer point daily😂
