I-485 Administratively closed, I-130 first actively being reviewed
hello fam,
I just got a message that my I485 got closed and I130 is being reviewed. I never got my EAD or AP, no rfe or anything. I am a little confused so can anyone share their experience ? thanks in advance!

I never got my EAD either. I called USCIS and they mentioned that it wasn’t properly scanned into the system and they are going to scan it and process it with the PD on the forms. I would advice to call USCIS and have them clarify over the phone and put in a request for your EAD

@tas smith pls what can I do ? I chatted with the live agent about my i765 but they ask me to write a letter to Vermont SC that they can't give me any Information about my case, why are they doing that? thanks

@O A I also seen cases where some people just get their green card and no ead either way do inquiry on both cases if you don't understand how to do it let me know

ok now there is a notice on the documents tab that says that I am in proceedings before an Immigration Judge and USCIS also determined that I am not an arriving alien because I was admitted on (my date of entry into the US) as B2. So then after reading this I’m like “wtf!? I don’t know anything about this” and went back to the EOIR website, like I did on Friday as recommended by @tas smith and, to my surprise, now there is a master hearing for may 2024 with docket date sep 2020. Any thoughts? I have zero idea on how to navigate this

@T Y first thing if you don't have lawyer get a good one second you need that i130 approved before you can move forward once you have that then the court will dismiss are terminated your case and you can go back to uscis to reopen your i485 case whatever you do don't try to do it by yourself

@O A you will not get your ead until your case is dismissed are terminated by the court ead is base off your i485 once your in removal uscis can't do nothing about your case guy's I have been through all of this before just had my interview with uscis now waiting for approval please lawyer up and brace yourself it will takes alot of time

@T Y you can definitely get EAD and you can renew it while being in removal proceedings. It is based on your pending I-485 and it is still pending, it is not denied, just temporarily closed. I've had work authorization for 3 years while being in removal. No advance parole though. AP will eventually be denied.
So what happened in September 2020? Did you get an NTA? ICE encounter?
You absolutely need a lawyer (not paralegals) to represent you in front of IJ. Never miss any hearings.
Your first step is to get I-130 approval. fyi uscis tends to shelf cases with removal proceedings. Then terminate removal proceedings based on approved I-130 ("dismissed without prejudice", not administratively closed), either file a motion to dismiss directly to immigration judge, or file a joint motion if ICE attorney is on board. Once you are out of removal, you can do the next steps on your own: reopen I-485 and get it adjudicated.
also, don't despair. This process will take time and money but it is totally doable. Many people here on lawfully successfuly overcame the removal proceedings and obtained green cards.

@Ice Cream honestly I have no idea what might have happened for them to summon me like that. I never had any problems with any authorities. I really appreciate your time to help me on this. I might call Hacking Immigration Law as I’ve seen a lot of their work on YouTube.

hello all! so, quick update, in Dec 21 my ead was approved and two days later got in my mailbox, and my AP was denied, just like @Ice Cream said. I’m working on getting a Lawyer so if you guys have any recommendations I’d be very grateful. this feels very scary. what happens after the master hearing (scheduled for may 2024)?

also, how can I work to get my I130 expedited? I called Emma and (a very rude agent) told me I have to have a specific reason within a list or some bullshit lol.
the paralegals I worked with to file my stuff told me they didn’t see anything on my name before they filed all my paperwork stuff. so after finding out I was in removal proceedings they said they would ask USCIS to expedite it and then write a letter to the immigration judge asking to have my removal proceedings “cancelled” and with his/her approval ask USCIS to reopen my case. they would charge me $1000 for that
