I-485 Adjustment of status - RFE
Hey guys. I got an RFE regarding the form for affidavit of support. They’re are asking me to send the documents for the most recent tax year with I believe it would be 2021 but my husband and I don’t know what to do because I don’t have my SSN yet and since I’m waiting for one I can’t get the ITIN. Does anyone know what to do can we file as married filing separately? Are there any other options? Thank you for the help!!
PS: the RFE is on my I-485 page, is it gonna affect my work permit or advance parole as well? Or they’re not related?

You should send updated taxes (2021) that your husband has filed, not you. Don’t also forget to add his w-2 showing his income for the year

why dint you guys filed married jointly?and you can send in 2020 for the most recent.i-485 and i-765 are not related so you will be fine

@N H 2021 is not available yet because i tried to print it out and the irs keep sending me pages saying its not ready yet

@butterdoll we talked to a H&R Block guy and he said I needed a SSN or ITIN to file jointly. but I’m waiting for my SSN and because of that can’t get a ITIN

@NH he needs to file his taxes for 2021 but we’ve been trying to figure out this problem so we can do it the right way and then I can reply for my RFE

@bianca i would send it in how it is married filing seperately with 2020 tax transcript and explain why with a cover letter thats it dont stress yourself out

man there are asking for your affidavit of support info u don’t have to worry about filing taxes becuz u don’t have any Ssn so either he gonna file as head of household single or separate you can’t be apart of his taxes as yet

@bianca Sanderson calm down, exhale. good. just have the affidavit of support completed n attached 3 years of his tax. you don’t have to worry bcus you not working and they know they just need information from him to see whether or not he qualifies to file for you financially or that he will need help. then if he needs help a family member will have to file i864a that lives in the same household ok.

I'm writing to everyone about any case that you have pending. Please take the time to write your local congressman about your pending USCIS case. We need to put pressure on this system. Look up your local congressman, they should have a web page where you can discuss an issue. Choose immigration or anything close and give a brief description of your case. Include your case #. We need to band together to create change. SPREAD THE WORD! Do this today lets help each other out.
