i-360 Religious worker
Can an employer withdraw an I-360 Religious Worker petition after it has been approved for more than one year? I have looked into the law on USCIS, and if the I-360 has already been approved, it belongs to the beneficiary, and USCIS will not accept a withdrawal. Is that correct? Anyone with experience, please share your thoughts

I also got my green card process through a religious worker case. It took almost a year for my I-360 to get approved. I don’t remember exactly, but I think it was just under a year—though very close.
Since the I-360 has already been filed, you're considered a beneficiary, but the issue is that you can’t currently file the I-485 based on the current visa bulletin dates. That’s the main problem.
Because of situations like this, some people actually choose to pursue other options, like EB-2 or EB-3, and start the green card process all over again. However, the downside is that if you go that route, you would need to file a new petition (I-140), and essentially start the entire process from the beginning—from the petition stage all the way through.

@R hope Once approved, an I-360 is considered an approved immigrant petition belonging to the beneficiary — but its validity is tied to the facts that supported approval (the bona fide job offer, the organization’s eligibility, and the beneficiary’s qualifications).
What the employer can do is notify USCIS that:
• the job offer is withdrawn,
• the worker no longer works for them, or
• the facts underlying the petition have changed.
USCIS has the authority to revoke the I-360 approval on notice (8 CFR §205.2).

My religious employer notified USCIS about withdrawing sponsorship after my I-360 had been approved. By then I had already joined another religious employer that agreed to file my petition. So, I had to start from the very beginning to file another R1, then I-360, then I-485. USCIS did not write to notify me about their withdrawal of my old I-360, though. I simply filed a new one and it got approved in less than two months.

@Nestor O how can you start another R1, your R1 still valid and change to new employer right? because my R1 expired It may be difficult to renew the new R1
