I-140 just approved, need an O-1, O-3?
Hi, thanks all for your virtual presence. My EB-1B outstanding researcher I-140 just got approved in 5 days with premium processing (and some delays because the first time my credit card saw the USCIS fees as “fraud alerts” and the whole concurrent package was sent back with open medicals, we lost 22 days)!! My H1B is expiring in 3 weeks (6 years and 230 days extension) so my employer is filing an O-1 for me so I can keep working while my I-765 (EAD) is pending. We are also filing O-3 visas for my dependents but my question is whether this is really necessary since we filed everything concurrently (I-765, I-485, I-131) for all of us?

May be you should be fine but better to check with your lawyers. no harm in having O1 visa that would help you and dependents to travel while your i131 ap is being processed

well, if I don’t have an O-1 I need to stop working on March 28. My country date of filing is “current” so with an employment based GC I can’t renew my H-1B anymore. My lawyer says we need to file for the O-3s so they have a status.

What a pity with the credit card fraud thing. And Congratulations to your approved I-140. Unfortunately I don't have an answer to your question about O-3 visa. But I have a question. Please what did you do to the open medicals? Resubmitted it that way or had to go for a reseal?

I don’t think it is necessary since your dependents cannot work on an O-3 anyways. Also, you cannot travel outside the US on an O-1 while your I-485 is pending, and I guess the same is true for an O-3. That being said, does your employer pay for the Os? If yes, I’d just apply for the O-3s too. Imagine your I-485 gets denied or something…

such a weird case, can you also share which credit card so I will avoid it. if there is not credit card issue you would have been fine?

@Y L they pay for my O-1, I have to pay for 3 O-3s. I think we need them for my dependents to have a status (useful to renew their driving licenses for instance). My lawyer says it’s better, even if we don’t travel and they don’t work for now

@anlu chen CHASE British Airways visa. It had 30k credit line, that’s why I chose it. The second time I wrote personal checks with my Bank Of America account. CHASE could not guarantee that it would work, too risky.

in the end I got my O-1 on time with premium processing, we also requested the O-3. Now we are waiting for the I-131 to be able to travel or the I-485 all together. We just did the biometrics and answered a RFIE on birth certificates and I-485j so I’m hopeful they are looking at my case, well 🤞
