I-140 Appel Denied with New I-140 (Before Sep-2022)
My I-140 Appel was denied last week 09/26/2023. After notice the Visa Bulletin in Sep.2022 I applied another I-140 / 485 / 765, that’s I already got the EAD valid until 2026.
My question is: My status today is coming from the previus 485/140 (Appel Denied) or my new 140 with EAD expires 2026?

Speak with a lawyer, your status comes from your previous 140&485 (unless you have another visa). As soon as you initial 140 was rejected your 485 is also rejected, in the coming days you will have the notification to leave the country. speak with a lawyer to plan a new strategy, but it seems you need to go back and apply for the consular process. I don't know if you can apply for a F1 or J1, but definitely you need a strategy with a lawyer

typically your old i-140 is linked to the current i-485 unless you requested a change of underlying petition.
