I-131 Terminated after Asylum based GC approval 😭
So after waiting for 1 year+ for the RTD, I got an email from USCIS that they have terminated my I-131 (RTD) application. This is ridiculous! Does it mean I have to re apply and wait for another 14months?? Email from USCIS: As a Lawful Permanent Resident of the United States, you no longer require an advanced parole document to allow you to return to the United States after temporary foreign travel. Therefore, your Form I-131, Application for Travel Documents, Parole Documents, and Arrival/Departure Records, will be terminated and this office will take no further action on this application.

@ivy Ivy I need Refugee Travel Document to act as a passport to be able to visit other countries. I can no longer use my cop passport.

The doubt I had just confirmed with your post, thank you. Did you understand the response, yes you can use your cop passport. If you have your own passport you don't need to apply RTD with GC on hand.

@Rose Lin I had the same situation. my attorney applied for a refugee travel document and they denied it saying I don’t need advance parole because I have a green card

@Rose Lin , this is interesting I've had several clients as paralegal continue using RTD. I'd say try reaching out to uscis and go to tier 2 to see what they say. clearly ask do you expect me to go to the embassy of my country of origin and get a new passport? please respond thru email so I can have that as a proof. if you get the response as clearly indicating please go to an embassy and get a passport, use that and go for a country of origin passport. this is very weird but I'd check all the boxes. i'll ask a couple attorneys about this. happy to share the reaponse in the group I'm running on private chat. you can join with a different name to keep anonymous: https://www.skool.com/uscis

are you sure your attorney didn't mistakenly apply for Advance parole instead of refugee travel document? it says you no longer require an advanced parole document. just making sure!

@Rose Lin With respect to this first part of your recommendation, the refugee travel document is only issued to a person granted refugee status or asylum in the U.S. Under the current statutory construct both refugee and asylum status are limited to one year, at the end of which the individual must apply for adjustment of status to permanent residence. Consistent with this statutory construct USCIS provides that refugee travel documents are to be valid for one year, or to the date the refugee or asylum status expires. USCIS continues to believe that it would be inappropriate given the current statutory construct to issue a refugee travel document beyond the person's status. Given a travel document is valid for ten years runs counter to the entire stafutorily mandated process to review the status of these individuals after ayear. It would also confuse customers with respect to when their status expires and when they should apply for permanent residence.

@Rose Lin at some point in the past ombudsman reached out to the USCIS to see why can’t they entend the validity period of RTD. and then they responded that asylum/refugee status is limited to one year. the way I read it that we should be ok with applying for a national passport

@Immigration Guy I applied for the RTD myself and I double checked my form. I checked the part for Refugee Travel Document. Not advanced parole. I even tried chatting to live agent through emma. the answer I got is even more bizarre! the agent told me that as a GC holder, I’m eligible to apply for a US passport. Of course I checked online right away and confirmed the fact that it’s not true. 🤦🏼‍♀️

@V V I checked from several sources online by typing “how to travel with asylum based Green Card” and most of the sources said not to use cop passport. use GC + RTD combo instead. Using cop passport is considered still taking advantage of cop’s benefit and may affect naturalization.

@V V The document you shared is from 19 years ago. Are you sure it’s still valid? I just don’t want to mess anything up especially with the political climate we’re facing in the near future. 😅

@V V the document you shared does not indicate anywhere that you're ok to use national passport unfortunately. to add to the confusion here's what it says on uscis website: USCIS issues refugee travel documents to people with refugee or asylum status and to lawful permanent residents who obtained their Green Cards based on their refugee or asylee status. this is the link where you can find that text: https://www.uscis.gov/green-card/green-card-processes-and-procedures/travel-documents

@Immigration Guy That link is one of the sources that I found regarding how to travel with asylum based GC. It just sucks how they terminated my previous application forcing me to reapply and wait another 14 months. Ridiculous! What’s the trick?

@Rose Lin I'd say apply for re-entry permit this time, it's validity is 2 years. the down side of it is that you need a visa almost everywhere with that document. not sure where you plan to travel to. i shared the tool airlines use to check where you can travel to in my group. would love to have you there: https://www.skool.com/uscis I also asked an attorney about it, will share with you the response there. it pretty much suggests re-entry permit which doesnt make 100% sense to me. I dont think uscis knows either lol
