I-130 wrongly sent to NVC, how long to get it transfer back from NVC to USCIS?
in 2018, our I-130 got approved. Today we had our I-485 interview. The interview went okay but officer told us she cannot make a decision until our I-130 case gets transferred back to USCIS. She said she has no idea why it is in NVC. Anyone has similar experience? How long does it usually take to get it back to USCIS? #I-130 #NVC #I-485

we got out I130 approved and sent to NVC on 01/14/23, our lawyer is working in transferring back to USCIS but nothing yet. 😕

contact a lawyer otherwise they will take their time....mine was transferred nvc Jan 2022 waited for 7 months never came so I contacted a lwy

@winnie w same here we submit my I130 in march 2021 and It was approved and sent to nvc .. my i485 is still pending..
about a week ago both my husband and I spoke to a Tier 2 officer and she clearly said when ever they need the i130 uscis will request it back from nvc ..
plus I had send nvc an email to let them know I won't be doing consular processing im already in the usa doing adjustment of status and if I should file i824 to forward back the approved petition.
nvc replied back and said that whenever uscis request back the i130 they will notify us in the mail.
So I hope uscis request it back before my Interview because I don't need no further stall up more than what we are going through with the long processing time.

please keep us updated I need to know when uscis request it and how long it take so if it's possibile I can get ahead of time to get pass this long and draining process .

during interview the officer said she will request it. I don’t know if she did. I’m worried this will take another year sigh. I already have the interview

@approved name Did you mean when uscis request from NVC, it is immediately sent back to USCIS? So officer could have adjucated the case right away?

at Winnie am just saying you should hv a lawyer to help you follow up your case uscis will say they will bring but it may take longer and be frustrating to you but when the lawyer I'd involved it comes faster I waited 7months and nothing came so I contacted a lawyer

@approved name I already have a lawyer. Lawyer was even with me during our I-485 interview. The officer says she will request it back but who knows if she did? What if she just leaves our file on the corner of her desk again.
