I-130 pending..
hi Guys! it’s been 19 month since we sent our I130. we only have the receipt number. we contacted USCIS and they told that the earliest we can submit questions is December which will be 21 months than!
what does does mean earliest we can submit questions? did anyone encounter the same thing? what does it mean? please let us?? PD is March 21, 2024

@Dimi Bam Are you adjusting status or an asylum? If you are doing an adjustment and are married to a US citizen then there is no priority date as there is no limit to how many green cards that can be issued to relatives of citizens. I read that your case is now at a field office. They will schedule an interview. Calling will not make anything happen. The earliest you can ask about it is what that date is. It is when you are beyond normal processing times.

@Kingsley B im doing adjustments and also my asylum is pending. how do you know they will schedule an interview ?

@Dimi Bam There is no way of knowing but if it is at a field office then they will do an interview at the field office. You will be notified by them.
How are you doing both? Adjustment can only be done if an asylum case is approved as you need to have an approved visa presence in order to file for adjustment. I could be very wrong but from what I aware of you cannot have both pending.

@Kingsley B we haven’t file the i485 yet. so it’s just the I130 for now. so you think we are going to have an interview for the i130 petition?

@Dimi Bam They might not interview you for just the 130. If you submitted a lot of evidence and they feel satisfied with your evidence, they might not. I was not interviewed for my GC. Your situation is more complex. I wish you the best. It is a long process and you will get through it.
